A High court judge justice Joseph Mafusire has freed a 24-year-old Mwenezi man who stabbed his wife to death with a chisel after evidence was led that he was mentally unstable at the time of the murder
Defence counsel led by Lucy Chivasa from the Legal Resource Foundation who represented Mikian Sandako told the court that accused heard some blows as he was sleeping and saw his wife as a goblin which resulted in him stabbing her twice above the breast and several times on the neck using a chisel.
Court heard that after stabbing his wife, Sandako then stabbed himself once on the neck.
Evidence was also brought to court indicating that Sandako once sought medical assistance from traditional healers over his hallucinations at night.
Dr Patrick Mhaka who examined Sandako at Chikurubi Psychiatric Unit in July this year concluded that at the time he committed the offence he was mentally disordered.
Prosecutor Takunda Chikwati had told the court that on the first of August last year, at around 6pm, Sandako arrived home from Ngundu and his now late wife, Chiedza Regera, served him supper and they retired to bed together with their two minor children.
As they were sleeping, Sandako woke up and stabbed his wife with a chisel on her breast and neck and she bled to death.
Court heard that Sandako also stabbed himself on his neck with the same chisel after which he loudly called his neighbor which alerted his father Luzani Sandako who was sleeping in another hut.
Luzani rushed to his son's bedroom to investigate but found the door to their hut locked. The father called his son and he opened the door and fell down with his clothes soaked in blood.
Court heard that Sandako's father then went into the hut and found his daughter-in-law already dead.
The matter was reported to the police and the wife's body was taken to the hospital for a post mortem while the husband was arrested.
That face could make a chisel go limp.
