It’s more than that. In California, I’ve seen illegals come in with OBVIOUSLY fake clinical reports (ultrasound report, for example) from Mexico, describing injuries, claimed to have occurred in the USA, for which the illegal is trying to get compensation.

I’ve always been honest with insurance adjusters about these reports, and pointed out inconsistencies which indicate the reports are fraudulent ... but I know there are docs who do the exact opposite and tell the insurance adjusters to pay the claim.

Insurance adjusters are, like everyone else, a mixed group, and some seem happy to go along with fraud if so advised by a physician.

Note that the largest accident insurance company in California, State Comp, is run by the State, so there’s no profit motive in reducing fraud.

In the early 1990’s, my sister was driving in LA and a crappy, rusty car in front of her slammed on the brakes with no warning. She hit them and a car behind her slammed into her and a bunch of mexicans got out of both cars complaining of neck and back injuries. When an illegal is at fault and smashes your vehicle, they get away free and clear because their licenses are bogus as well as that insurance card they fork over.

Do I mind that my insurance went way up to pay for their damage? Hell yes.

Do not believe it. Due to jury hostility to illegal immigrants, their limited and often difficult to verify incomes, their transitory lifestyle, fear of getting exposed to deportation due to a civil legal processes, and their tendency to take small settlement offers, insurance adjusters and lawyers usually low ball any settlement offers and are willing to take cases to trial. The claim of "prior injury" is an old insurance company dodge, but the reason that it rarely works as to illegal immigrants is that those with a significant injury are unable to get hired for and cannot withstand the hard manual labor that is the usual role for illegals.

And, to make a larger point, quite often, when an illegal gets a personal injury award, they go home for good because they can afford it in that living expenses are far less in their home countries. Shed no tears for such insurance companies, because ultimately, the premiums imposed to pay for awards to illegals tend to fall on those who employ them and who benefit from their labor. Indeed, if insurers required e-verify as to all employees of their insureds and for any contractors they hire, many illegals would be fired and forced to return home.
