This morning I watched Judge Napolitano state unequivocally that the POTUS has the legal power to order surveillance on any citizen without a FISA order. Seems odd, I admit...but that's what he said.
I now just saw Gen. Hayden on Fox state unequivocally that Obama couldn't have ordered surveillance on Trump even if he wanted to. It is illegal.
Good Lord....why is it so damn difficult for these so called legal experts to get on the same page? It's either legal or isn't.
Definitions of wiretapping all depend on who’s doing it.
The myriad of laws on the books makes anything possible. We have so many that every American is a criminal each day we wake up and have coffee.

The Gov can do whatever it wants.
For a lot of people (mostly left)
“legal” means “I’m ok with it”. (see planned parenthood or sanctuary cities)
“illegal” means “I don’t like it” (see police doing their job or conservative speakers who should be arrested for “hate speech” or the 9th circuit on immigration)
There are exceptions though. For example they may say “If Obama did it, it’s legal” even about something they don’t like.
The language must be changed in order to change (alter or eliminate) American society.
America and our Constitution has always been the prize.
President Trump ... AND US ... are the last hope and stand for the "America again".
If we fail, there will be no other strong enough to stay the hand of the enemy(s)
The root cause, is that USConstitution is being destroyed. All _laws_ which contradict it, destroys it; makes it of no effect. The _laws_ which allow warrantless search and forfeiture destroy it. Without a firm foundation the structure being built (law), leans and warps; shims need to be put in all over, to rectify the distortions appearing through-out the twisted structure.
Those wanting to empower USGov beyond USConstitution, must amend it. Quite participating in the destruction of true _law_ ...

Basically, the law allows (or does not address) the executive to conduct any type of surveillance he deems necessary for counterintelligence purposes.
This was widely done in the 60’s and early 70’s against “US Persons” (basically anyone legally in the US or a US Citizen overseas - includes Corporations). After much gnashing of teeth when President Nixon conducted such activities against the Anti-War crowd - we got
1. the Privacy Act
2. the FISA Court
BUT - the prohibition to spy on US Persons did not come until later and is the result of an Executive Order.
IOW, there is no law specifically forbidding the electronic surveillance of (and retention of data concerning) as US Person. The EO can be rescinded by the President at any time.
Just because someone is on TV talking, doesn’t mean they are an expert.
I do not trust Hayden.

I clicked on the TV JUST BEFORE Judge Napolitano launched into one of his customarily brilliant commentaries on the current Democrat created Russian NON-SCANDAL that has BACKFIRED on them into the burgeoning WIRETAPPING SCANDAL that should — if Congress does it’s job (FOR A CHANGE) — put obozo and/or his mendacious minions in the slammer! This is EXPLOSIVE STUFF and puts the lie to the FAKE NEWS the left and media (but I repeat myself!) on PMSNBC, NBC, CNN, etc. have been dispensing!
