She was returning home after an extra-long shift and saw what she thought was a home invader. Who then proceeded not to comply with her instructions. We are talking about someone in the confined quarters of an apartment living room, who is bigger and stronger than she is, and is one rush away from taking her gun away from her and beating her to death with it. I’d say she skates. It was a tragic mistake, but finding someone in your home will kick off a fight-or-flight response that short-circuits your reasoning skills in favor of rapid action to neutralize the threat before you are neutralized by the threat.
Whereas someone who’s setting up a target has plenty of time to figure out what’s behind the target and what might be hit by stray bullets. In any event, it is important to deter any future accidents that are fairly easy to avoid with a bit of thought beforehand. Prison time and hefty damages are therefore appropriate.
Never mind. I ask a simple question. It needed a simple answer not a could a, would a, should a, Apple/Orange type.
