The grandfather of tragic Chloe Wiegand was 'unquestionably' aware that he was dangling the toddler out of an open window before she plunged to her death from the 11th deck of a cruise ship, a new court filing alleges.
Royal Caribbean says Salvatore Anello would only have had to use his 'basic senses' to appreciate the danger this posed to 18-month-old Chloe, who died instantly when she landed on a concrete dock in San Juan, Puerto Rico on July 7.
'There was no 'hidden danger - Mr Anello knew the window was open,' the cruise operator boldly states in documents obtained exclusively by DailyMail.com.
Anello has been charged with criminal neglect by Puerto Rican authorities for allegedly dropping Chloe from the side of the Freedom of the Seas ship.
But Chloe's parents Alan and Kimberly Wiegand countered with a multi-million dollar negligence suit last month that blames Royal Caribbean for failing to install safety devices or warning signs on a waist-height glass window that Anello says he didn't realize was slid wide open.

The parents are suing Royal Caribbean. I have to side with the business here, it’s hard to believe the grandfather didn’t know the window was open when he was dangling the kid out of it like Micheal Jackson swinging his kid over the balcony.
Ugh. If I were the grandpa who (accidentally) did that, I’d pray they’d just kill me. Terrible.
I might be a little slow sometimes, but I can still tell the difference between an open and closed window while seated next to one.

Oh dear, watch the video. The grandfather was leaning out the window himself and then he bends down to pick up the child a dangle her over. He knew.

He should be facing 3 years hanging from a rope.
He was clearly holding the kid up to wave to the crowd and the kid slipped. Tragic. What could the company do? Put up a sign that says “don’t do anything stupid?”
He has some kind of eye defect. Can’t remember. Maybe colorblind.
He most definitely dangled her OUTSIDE the window Michael Jackson style. A few passengers were looking that direction. Wonder if she were screaming and wiggling to be back inside? He’s not just a killer but a liar as well. He needs to be locked up for much longer. Or is stupidity not illegal?

I’m confused. Does Royal Caribbean have signs on closed windows saying “dangle babies here” and they put one in front of an open window?

Judging by all the cruises I’ve taken, breeze” is an understatement. I recall something more like a gale. He knew.

No, he purposely put the child at risk. This was negligent horseplay.
Yeah, three years? Remind me when I become a murderer to be in Puerto Rico.
And at the same time, never go to Walmart at 2:00 A.M. to buy duct tape, gloves and a trash can.
Says the company being sued. The court will decide if that is factual.
