New rent law helps tenant jailed in Rikers on murder charges beat eviction

He’s locked up on murder charges — but still has a rent-regulated apartment.

A deadbeat tenant who allegedly killed a man in his Bronx apartment beat an eviction proceeding while in jail on Rikers Island thanks to a controversial new state rent law, The Post has learned.

Charles Votaw’s landlord first slapped him with a 10-day notice demanding more than $7,000 in unpaid rent on June 6 last year, the first step to boot him from his federally subsidized Section 8 apartment in Fordham Heights.

But on June 14, Gov. Andrew Cuomo signed the Housing Stability and Tenant Protection Act of 2019, which took effect immediately, mandating that landlords give 14 days’ notice before beginning eviction proceedings.

Votaw didn’t pay up, even after landlord WFHA Creston Avenue LP filed a July 30 eviction suit — but responded with a check-off form in which he entered a “general denial” to the claims on Sept. 3, records show.

Ten days later, Votaw was busted when cops found the rotting corpse of Jason Nieves inside Votaw’s second-floor apartment at 2323 Creston Ave.

Nieves was killed during a fight in which Votaw allegedly knocked him out, tied him up with duct tape and slit his throat, authorities said.

The slaying wasn’t discovered until days later, when cops responded to a complaint of a foul odor coming from the apartment.

While locked up without bail, Votaw was represented for free by a lawyer from the nonprofit Mobilization for Justice, which sought to have the eviction suit dismissed on grounds that he wasn’t served with a 14-day rent demand.

WFHA Creston plans to resume eviction proceedings against Votaw, but it will likely take four to six months before his apartment can finally be rented again, Bianco said.

Let's clarify this a little bit... First and foremost, the taxpayers are paying most of the bill for his rent - it's section 8 subsidized. Since he owed more than $7,000 in back rent, he's NEVER paid his portion of the rent. While all this is going on, the taxpayers are STILL paying the majority of his rent even while paying his incarceration as well.

Screwing taxpayers coming and going here.

Those rules are state wide as of july 2019 (not just NYC). One of the most stupid laws is that you can’t turn someone down based on their evictions. And they’ve “sealed” all eviction records.

The majority of “upstaters” are disgusted beyond belief but downstate overrules us by population. We need a state electoral college.

Most of us have voted with our feet.

Why anyone would get into the rental business in NYC I can’t imagine

Some got in decades ago when it was workable (even with the rent control of the era). President TRump's father was one such man. Trump wisely went upscale, where the worst of the problems don't exist.

It is even worst than that.

For decades, maybe even centuries, one of the most sure-fire ways for a middle class family to move up in the world was to start a sideline in the rental real estate business. It took work and dedication, but over a period of time one could move from the middle class to lower upper class.

DW and I have benefitted greatly from doing this, but now rent control and stupid regulations which prevent tenant screening have made this a much less attractive proposition.

The Dems do not want a thriving entrepreneurial class in the US -- we vote conservative.
