A Tennessee man faces a felony murder charge after he allegedly broke into an Arlington Heights home Saturday to rob a family at gunpoint and the homeowner shot and killed his accomplice, police say.

Bradley J. Finnan, 38, of Chattanooga, and his accomplice Larry Brodacz allegedly rang the doorbell of a home in the 2400 block of North Evergreen Avenue in a “targeted” robbery, Arlington Heights police said in a statement.

Finnan and Brodacz, who was armed with a gun, entered the home and were attacked by the homeowner, police said.

After a struggle, the homeowner chased Finnan out of the house and went back in to get a gun from a safe as he saw Brodacz pointing a gun at his wife and two children, police said.

Brodacz, also armed with a knife, then attacked the home owner, police said.

“Fearing for his life and the lives of his wife and children, the homeowner discharged a round from the family handgun, striking Mr. Brodacz in the abdomen,” police said in the statement.

That's a new one on me.
It's a correct indictment, however.

We have an Attorney General here in Massachusetts who a) is a filthy bull dyke and b) has complete contempt for the 2nd Amendment, and doesn't try to hide that contempt. I can guarantee that here in the Gay State it's the *homeowner* who would be up on murder charges.

And BTW...most of the state's counties have a District Attorney that's every bit as filthy as the Attorney General.

He’s keeping his gun in the wrong place.

He lucked out.

“After a struggle, the homeowner chased Finnan out of the house and went back in to get a gun from a safe...”

Lucky his whole family wasn’t killed during the delay.

The logic is that the accomplice would not have died if not for the actions of the other.

IIRC many states have a law that says that if anyone dies while two,or more, individuals are engaged in any kind of robbery or home invasion, those engaging in the felony are guilty of murder. It doesn't matter who actually caused the death. It can be a cop who killed someone during it...or it can be a homeowner,as in this case.

There's a legal name for that but it slips my mind.

That’s about 30 minutes from me. What are those billies doing up here trying to pull a job? Yes, in illannoy when a criminal is killed during commission of a crime his/her accomplices are charged with murder.

Illinois has no death penalty. This punk will be out in 10 years...probably because of “prison overcrowding”.

How about”hey don’t hurt my wife or kids, I have money in the safe, let me open it for you”, then grabbed the gun and shot him.

That’s how it should be. The invaders are responsible for everything that happens because of their invasion. The homeowner’s action was not a crime at all. The surviving pos bears 100% responsibility for the death of the other, and should be executed for home invasion, and murder.

depending on state law, if you commit a felony and someone dies in the commission of that felony then you’re responsible for their murder.

If you rob a bank and you agree with your accomplice not to even bring a real gun and not to shoot anyone but they do anyway and shoot someone you are liable for murder. At least in California I don’t the law on a state-by-state basis.

This is a not uncommon use of the felony-murder rule. It’s a first week in law-school hypothetical that shocks a lot of students.
