Based on what I read in the article it sounds like had this happened in my commonwealth of Kentucky there might not have been charges filed. Here you can use deadly force if a reasonable person would fear serious bodily harm.

Terrible article. Facts must have been left out.
The officer claimed the guy attacked him and knocked him down? Then why did he shoot the mom and dad? And how does a nonverbal disabled guy put an armed cop in fear for his life?

I remember this shoot. He shot both parents too, and claimed he was disoriented from a blow to the head, thought he had been shot and that French was pointing a gun at him. He fired 10 rounds from 20 feet away, striking all three family members. He is getting much fairer treatment than any of us would get. Were he not a cop, he would be 2 years into a murder sentence.

So the county DA did an investigation and the grand jury declined to press charges - so the state DA decided to file anyway.

The officer claimed the guy attacked him and knocked him down? Then why did he shoot the mom and dad? And how does a nonverbal disabled guy put an armed cop in fear for his life? Apparently the deceased punched or slapped the off duty cop in the back of the head, unprovoked. The family were all grouped together, 20 feet away from the LEO when he fired at what he claimed/thought was an armed man. Mom and dad were collateral victims?

A grand jury only hears information from the police and prosecutors. The family’s side of this (and the Costco surveillance video) was not heard by the grand jury.

I’d guess the video does not support the cops version of events. Seems we’ll have to wait and see.
