Alec Just Filed a Lawsuit A Year After ‘Rust’ Tragedy—He Wants to ‘Clear His Name’

Alec Baldwin filed a lawsuit a year after the Rust incident. According to court documents, Baldwin seeks to “clear his name” after the accidental death of Halyna Hutchins on the set of his movie.

People obtained the legal court documents of a cross-complaint filed by the 30 Rock actor. The lawsuit reads, “More than anyone else on that set, Baldwin has been wrongfully viewed as the perpetrator of this tragedy.” The cross-complaint named on-set armorer Hannah Gutierrez-Reed, first AD Dave Halls, property master Sarah Zachry, and weapons supplier Seth Kenney, accusing them of negligence. “Baldwin has also lost numerous job opportunities and associated income,” the lawsuit reads. “For example, he’s been fired from multiple jobs expressly because of the incident on Rust and has been passed over for other opportunities, which is a direct result of the negligence of Cross-Defendants Gutierrez-Reed, Halls, Kenney, PDQ, and Zachry.”

I think hes one of the main people responsible ultimately because he’s the producer and the actor who pointed it at someone/direction rehearsing when maybe he could have rehearsed the move in a safer way. Hes got executive responsibility and personal negligence aiming it somewhere to test a move out that he could have aimed elsewhere.

That said, actors trust armorers and the other director on site who both cleared the weapon on set before handing it to him. Those two people are responsible as well, especially the armorer.

No actor who has been given a firing prop weapon that he’s seen/heard two other people, one being the armorer, say the weapon is clear, would think has an actual live round in it. Even a blank’s wadding can injure/kill if a person is within 10 feet and hit in certain places. But no way would any actor think after a weapon i handed to him by an armorer and told its clear by 2 people that theres a live round in it. I’d look because I just don’t trust anyone. But I can see most people not doing so.

Giving Alec Baldwin a gun, knife or even that lefty pair of safety scissors you always got in kindergarten must be an act of negligence. Looks like he's suing everyone involved other than the producer of the movie.

One live round, six live rounds, five blanks and a live round, six blanks that weren’t really, five live rounds and a blank? what the bleep was in it? I'm not sure of the others, but from all accounts the armorer lost chain of custody. It was her most critical priority in that job. Unbelievable that the daughter of one of Hollywood's best known armorers didn't know live ammo was on her set (illegal), nor that many handguns were sitting on a movable tray. She screwed up to the max.

While Baldwin was stupid enough to point and pull the trigger, if I was handed a supposedly safe handgun from a professional armorer, maybe I could make the same mistake.

I know the argument is Baldwin should have checked the weapon and ammo, but how many actors can discern from live ammo and blanks, especially after being handed from the armorer?

Still, he may be guilty of involuntary manslaughter. It wasn't even a real scene being filmed, he was playing around and killed the woman out of stupidity.

Makes no difference. Even if you SAW the previous possessor clear the weapon, when you receive it into your hands you clear it AGAIN. That is an absolute hard and fast rule, no exceptions.

I once cleared a Rem 870 after a friend handed it to me, and a shell popped out of the receiver. It apparently had hung up in the magazine. The look on my friend's face was a study.

Ian McCollom, of Forgotten Weapons confessed to one accidental discharge. A museum allowed him to handle a 19th Century, Colt "potato digger" machine gun, chambered in 6mm Lee Navy. It was nonfunctioning, and Ian, being very knowledgeable about firearms, went through the procedure to clear the action, and got it to clear. He then pulled the trigger, to verify that he had restored the weapon to functioning, and its operational status was verified with a bang, as a 100 year old 6mm Lee Navy cartridge, which had been inside the machine gun for many decades, as it went from museum to museum, went off.

If a 19th Century machine gun, chambered in a cartridge not manufactured for nearly a century, displayed in a museum can be loaded, any weapon can be loaded.
