The former FBI informant charged with lying about a $10 million-dollar bribery scheme involving President Joe Biden´s family is set to appear in a California federal court on Monday.
A judge will determine whether Alexander Smirnov, 43, must remain behind bars while he awaits trial.
Special counsel David Weiss' office is pressing U.S. District Judge Otis Wright II to keep Smirnov in jail, arguing the man who claims to have ties to Russian intelligence is likely to flee the country.
A different judge last week released Smirnov from jail on electronic GPS monitoring, but Wright ordered the man to be re-arrested after prosecutors asked to reconsider Smirnov's detention.
Wright said in a written order that Smirnov's lawyers' efforts to free him was 'likely to facilitate his absconding from the United States.'
In an emergency petition with the 9th U.S. Circuit Court of Appeals, Smirnov's lawyers said Wright did not have the authority to order Smirnov to be re-arrested.
The defense also criticized what it described as 'biased and prejudicial statements' from Wright insinuating that Smirnov's lawyers were acting improperly by advocating for his release.
Smirnov is charged with falsely telling his FBI handler that executives from the Ukrainian energy company Burisma had paid President Biden and Hunter Biden $5 million each around 2015. The claim became central to the Republican impeachment inquiry of President Biden in Congress.
In urging the judge to keep Smirnov locked up, prosecutors said the man has reported to the FBI having contact with Russian intelligence-affiliated officials.
Prosecutors wrote in court filings last week that Smirnov told investigators after his first arrest that officials associated with Russian intelligence were involved in passing a story to him about Hunter Biden.

Smirnov didn’t kill himself
He’s probably ‘lying’ over the amount of the bribe, according to the DOJ. They can get you over any technicality, if the bribe is actually $50 million, you’re a liar if you claim it’s $10 million.
Smirnov was arrested as he stepped off a plane. I wonder how Biden lured him to the US. Seems like he was set up.
So they appoint a special counsel to investigate Bidementia

I think that is correct, and Wright should release Smirnov immediately. Smirnov was out on his own recognizance and was legally a "free" man subject to the terms of a Federal court order. As long as he was not in violation of the court order, he could not be "rearrested" since he had already been arrested. The jailing of Smirnov a second time is a travesty. When Smirnov was released by Magistrate Judge Daniel Albregts, Albregts warned him, "Don't make a mockery of me." The ones making a mockery of this are DOJ agents and Judge Wright.
I believe Smirnov reported that he was told about the two $5 Mil bribes, not that he had direct knowledge. The Dems initially dismissed the claim since it was a third party claim. It’s pretty hard to prove that someone who is not identified did not provide the information. He is most likely going to be incarcerated so the likes of Tucker or Tucker like does not publish an interview with him.
How are Smirnovs lawyers acting “improperly” when they are trying to get their clients released? That is what lawyers are supposed to do.
This Democrat-Stalinist legal logic is destroying another institution in America.

He should have the evidence so once in court, he’ll pull it out and case closed.

The initial claims that I saw on the internet was that Burisma Executive told him about the bribes. He did not witness them personally. So if he said that, then he told the truth. Don’t see where the Conflict is for the DOJ, where did he lie?
Incredibly, much of America is pleased with the platform of the Democrat party. They will be very competitive in November.

Why is lying to the FBI ok and just fine if you are spewing BS about any conservative. Be it a potential US Supreme Court justices or president.
