Politico are reporting the treatment of Trump’s "fake electors" has varied wildly by state

Eighty-four Republicans in seven states falsely claimed to be Donald Trump’s presidential electors in December 2020. Three and a half years later, dozens of them are facing criminal charges that could land them in prison for years.

Dozens of others have not been charged at all.

Even though the fake electors all participated in the same scheme, some have been charged as dangerous criminals while others have been treated as mere dupes. These disparities depend almost entirely on where they live.

In Arizona, Michigan and Nevada, every fake elector is facing felony charges except one, whose charges were dropped in a cooperation deal. Their counterparts in New Mexico, Pennsylvania and Wisconsin aren’t facing any charges. And in Georgia, three fake electors have been charged alongside Donald Trump, while others struck immunity deals.

Meanwhile, an architect of the scheme across all seven states, Wisconsin lawyer Kenneth Chesebro, has only received what some experts call a slap on the wrist after he reached a plea deal in Georgia, and he hasn’t been charged in any other state. The attorneys general in Georgia and Arizona are the only state prosecutors to charge any of the alleged organizers of the scheme. At the federal level, special counsel Jack Smith cited Trump’s involvement in the fake electors’ project in his Washington, D.C., case against him.

Nixon and Kennedy both had slates of electors. Originally Nixon was declared the winner but after a recount Kennedy was declared the winner. No “fake elector” charges were brought. All the reporting on this focuses on whether the recount was finished or not, whether it happened under a full moon, etc. to say the Hawaii situation was “different”.

So the difference is that now the Democrats have unilateral absolute power to declare what constitutes a “legitimate” debate, while they mail millions of un-requested absentee ballots all over the country because “Covid”.

If alternate electors claimed via the documents they signed and sent to Washington that they were the duly authorized electors for the state then they were in the wrong and they will get thumped.

Note that the attorney for Cheseboro claims that alternate electors in states like Arizona went beyond what was recommended when they claimed they were the duly certified electors for the state.

I don’t understand the alleged crime. Was there any intent to defraud? Any real possibility that the alternates could have been chosen when they were not legally entitled to be chosen? Or were the alternates just inartfully saying something like, “choose us if the other slate is properly found ineligible due to election fraud”?

The template for this should be 1876. Unless you have Congress determine that a state’s votes were incorrectly counted, there can be no such thing as “fake” electors, only “alternates.” And even then, Congress did not call the slates “fake,” only replaced them with others the majority thought was just.
