As long as no federal dollars are involved, there is nothing to stop a given state from exercising its 10th Amendment-protected state powers to give illegal aliens in-state tuition imo. But doing so ultimately depends on the threshold of wallet pain of a given states taxpaying voters.

Interesting. According to Rubio, an illegal Mexican should pay less tuition in Texas than an American from New Mexico would. An illegal Haitian in Florida would pay less tuition than a legal citizen of Georgia would. This is one of many areas in which Rubio is completely out of touch with decent people and with decent values.
And American kids will still pay the full fair and then some.
