"Bobby Schindler said on Fox News (Hannity & Colmes) that they were told there was a 4 year statute of limitations. The family presented the evidence and that was the answer. So, contrary to media reports, LE didn't "refuse" to investigate, no action could be taken."

That can't possibly be accurate. Heck, it takes 7 years to clean up bad credit! Could it be that law enforcement neglected to do an investigation at the time and they are trying to cover their butts now as well? If this were really true, then it would mean that Terri would have to be dead for a murder/attempted murder investigation to be launched. On the other hand, if Michael begins to see that he may become the subject of a murder investigation if Terri is dead, it may make him have a "revelation" that perhaps killing her off at this point may not be the way to go.

Ethan, do you know what the statute of limitations is on attempted murder in the State of Florida?

I don't believe that statute of 4 years. Period.I sent him an email-rather vivid, I expect un-christain and for that I am sorry-and he replied with SUCH A LIE I was stunned. So I responded back-again-with vitriolic but RIGHTEOUS anger. Here is how it went. ( Hold your nose! ) ( And*** you might want to skip the affidavit by carla iyers and article in WND, as I know you are aware of them-sent them to Press for background info just for him!)

Subj: Your article on Terri is horrendous, demonstrates your lack of knowledge

Mr Press-

Your astoundingly one sided take on Terri's plight is offensive, extremely elementary and heartless.

Are you aware of ANY of the facts associated with the court rulings that led to her feeding tube being ordered removed by her husband?

Are you aware of what her husband has done for the 13 years during her tragic existence?

Are you aware of the lengths her family, who LOVES her, has had to go to keep this woman alive.

Are you aware of the affidavits that have been ignored throughout the court hearings?

Are you aware that Michael took money to rehabilitate Terri-to the tune of over one million dollars and then ORDERED no THERAPY for Terri?

Are you aware of the physicians and nurses and friends of Terri that DISPUTE what has been done for terri according to michael?

Are you aware that felos, Michaels Attn, author of a book on how to help people die, has himself, in his book, told the stories of how he has gotten up into the faces of comatose people and YELLED into their faces "DO YOU WANT TO DIE?????DO YOU????DO YOU WANT TO DIE????

Are you aware that attn Felos was on the board of DIRECTORS of the Hospice that took terry in.....now he has resigned from that post...but helped michael get MEDICAID to pay for it...and that Michael lives in an extremely well to do house and drives and $80,000 dollar mercedes?

Are you aware that michael is having a SECOND baby with his live in love and wants to marry her but unless TERRI is dead he cannot because his wife's parents are strict catholics and that prevents marriage unless married boyfriend gets an annullment from the pope or the spouse is DEAD?

Are you aware that Michael ordered the physician at the Hospice (YES mr Press, when you are at a hospice the guardian has the right to order the attending physician of his or her choice on all matters-scary, huh?) to do NOTHING to sooth or help Terri-that the physician had to admit that even Terri's teeth were not brushed....estimated for years on this....?

Are you aware that Terri's parents LOVE her and WANT her and have offered Michael half a million DOLLARS in order to have their dtr with them....that their dtr expresses JOY when they are in the room?

I know you don't care bill...your arrogance is only matched by your cold hearted lack of knowledge that comes from laziness and wanting so badly to be on the cutting edge of liberal like psuedo-intellectual crap.

So I know that the attached articles will bore you to tears, if you have even gotten this far...but there is SO MUCH more to this...so much more....and your article demonstrates that you took the shallow, easy, pontificating approach without including the balance upon which Terri's life depends.

I am ashamed of you, for you and regret that you wrote this piece of pure hell.

Please read the enclosed if you can break away from from your Starbucks coffee or smoozing with your shallow enablers;

AFFIDAVIT

_________ STATE OF FLORIDA )
COUNTY OF PINELLAS )

BEFORE ME the undersigned authority personally appeared CARLA SAUER IYER, R.N., who being first duly sworn, deposes and says:

1. My name is Carla Sauer Iyer. I am over the age of eighteen and make this statement of my own personal knowledge.

2. I am a registered nurse in the State of Florida, having been licensed continuously in Florida from 1997 to the present. Prior to that I was a Licensed Practical Nurse for about four years.

3. I was employed at Palm Garden of Largo Convalescent Center in Largo, Florida from April 1995 to July 1996, while Terri Schiavo was a patient there.

4. It was clear to me at Palm Gardens that all decisions regarding Terri Schiavo were made by Michael Schiavo, with no allowance made for any discussion, debate or normal professional judgment. My initial training there consisted solely of the instruction "Do what Michael Schiavo tells you or you will be terminated." This struck me as extremely odd.

-1-

5. I was very disturbed by the decision making protocol, as no allowance whatsoever was made for professional responsibility. The atmosphere throughout the facility was dominated by Mr. Schiavo's intimidation. Everyone there, with the exception of several people who seemed to be close to Michael, was intimidated by him. Michael Schiavo always had an overbearing attitude, yelling numerous times such things as "This is my order and you're going to follow it." He is very large and uses menacing body language, such as standing too close to you, getting right in your face and practically shouting.

6. To the best of my recollection, rehabilitation had been ordered for Terri, but I never saw any being done or had any reason at all to believe that there was ever any rehab of Terri done at Palm Gardens while I was there. I became concerned because Michael wanted nothing done for Terri at all, no antibiotics, no tests, no range of motion therapy, no stimulation, no nothing. Michael said again and again that Terri should NOT get any rehab, that there should be no range of motion whatsoever, or anything else. I and a CNA named Roxy would give Terri range of motion anyway. One time I put a wash cloth in Terri's hand to keep her fingers from curling together,
-2-
and Michael saw it and made me take it out, saying that was therapy.

7. Terri's medical condition was systematically distorted and misrepresented by Michael. When I worked with her, she was alert and oriented. Terri spoke on a regular basis while in my presence, saying such things as "mommy," and "help me." "Help me" was, in fact, one of her most frequent utterances. I heard her say it hundreds of times. Terri would try to say the word "pain" when she was in discomfort, but it came out more like "pay." She didn't say the "n" sound very well. During her menses she would indicate her discomfort by saying "pay" and moving her arms toward her lower abdominal area. Other ways that she would indicate that she was in pain included pursing her lips, grimacing, thrashing in bed, curling her toes or moving her legs around. She would let you know when she had a bowel movement by flipping up the covers and pulling on her diaper and scooted in bed on her bottom.

8. When I came into her room and said "Hi, Terri", she would always recognize my voice and her name, and would turn her head all the way toward me, saying "Haaaiiiii" sort of, as she did. I recognized this as a "hi", which is very close to what it sounded like, the whole sound

-3-

being only a second or two long. When I told her humrous stories about my life or something I read in the paper, Terri would chuckle, sometimes more a giggle or laugh. She would move her whole body, upper and lower. Her legs would sometimes be off the bed, and need to be repositioned. I made numerous entries into the nursing notes in her chart, stating verbatim what she said and her various behaviors, but by my next on-duty shift, the notes would be deleted from her chart. Every time I made a positive entry about any responsiveness of Terri's, someone would remove it after my shift ended. Michael always demanded to see her chart as soon as he arrived, and would take it in her room with him. I documented Terri's rehab potential well, writing whole pages about Terri's responsiveness, but they would always be deleted by the next time I saw her chart. The reason I wrote so much was that everybody else seemed to be afraid to make positive entries for fear of their jobs, but I felt very strongly that a nurses job was to accurately record everything we see and hear that bears on a patients condition and their family. I upheld the Nurses Practice Act, and if it cost me my job, I was willing to accept that.

9. Throughout my time at Palm Gardens, Michael Schiavo was focused

-4-

on Terri's death. Michael would say "When is she going to die?," "Has she died yet?" and "When is that bitch gonna die?" These statements were common knowledge at Palm Gardens, as he would make them casually in passing, without regard even for who he was talking to, as long as it was a staff member. Other statements which I recall him making include "Can't anything be done to accelerate her death - won't she ever die?" When she wouldn't die, Michael would be furious. Michael was also adamant that the family should not be given information. He made numerous statements such as "Make sure the parents aren't contacted." I recorded Michael's statements word for word in Terri's chart, but these entries were also deleted after the end of my shift. Standing orders were that the family wasn't to be contacted, in fact, there was a large sign in the front of her chart that said under no circumstances was her family to be called, call Michael immediately, but I would call them, anyway, because I thought they should know about their daughter.

10. Any time Terri would be sick, like with a UTI or fluid buildup in her lungs, colds, or pneumonia, Michael would be visibly excited, thrilled even, hoping that she would die. He would say something like,

-5-

"Hallelujah! You've made my day!" He would call me, as I was the nurse supervisor on the floor, and ask for every little detail about her temperature, blood pressure, etc., and would call back frequently asking if she was dead yet. He would blurt out "I'm going to be rich!" and would talk about all the things he would buy when Terri died, which included a new car, a new boat, and going to Europe, among other things.

11. When Michael visited Terri, he always came alone and always had the door closed and locked while he was with Terri. He would typically be there about twenty minutes or so. When he left Terri would be trembling, crying hysterically, and would be very pale and have cold sweats. It looked to me like Terri was having a hypoglycemic reaction, so I'd check her blood sugar. The glucometer reading would be so low it was below the range where it would register an actual number reading. I would put dextrose in Terri's mouth to counteract it. This happened about five times on my shift, as I recall. Normally Terri's blood sugar levels were very stable due to the uniformity of her diet through tube feeding. It is medically possible that Michael injected Terri with Regular insulin, which is very fast acting, but I don't have

-6-

any way of knowing for sure.

12. The longer I was employed at Palm Gardens the more concerned I became about patient care, both relating to Terri Schiavo, for the reasons I've said, and other patients, too. There was an LPN named Carolyn Adams, known as "Andy" Adams who was a particular concern. An unusual number of patients seemed to die on her shift, but she was completely unconcerned, making statements such as "They are old - let them die." I couldn't believe her attitude or the fact that it didn't seem to attract any attention. She made many comments about Terri being a waste of money, that she should die. She said it was costing Michael a lot of money to keep her alive, and that he complained about it constantly (I heard him complain about it all the time, too.) Both Michael and Adams said that she would be worth more to him if she were dead. I ultimately called the police relative to this situation, and was terminated the next day. Other reasons were cited, but I was convinced it was because of my "rocking the boat."

13. Ms. Adams was one of the people who did not seem to be intimidated by Michael. In fact, they seemed to be very close, and Adams would do whatever Michael told her. Michael sometimes called Adams at

-7-

night and spoke at length. I was not able to hear the content of these phone calls, but I knew it was him talking to her because she would tell me afterward and relay orders from him.

14. I have contacted the Schindler family because I just couldn't stand by and let Terri die without the truth being known.

FURTHER AFFIANT SAYETH NAUGHT.

Doctors: Terri case not 'death with dignity' issue WorldNetDaily.com | October 22, 2003 | Diana Lynne

Removal of feeding tube called 'state-sponsored euthanasia'

October 22, 2003

A physicians' group has added its voice to the din of reaction to Florida Gov. Jeb Bush's intervention in the case of Terri Schindler-Schiavo, the brain-disabled woman whose life-sustaining feeding tube was removed last week at the request of Terri's husband and guardian, Michael Schiavo.

Schiavo, who maintains his wife is in a persistent vegetative state and would want to be allowed to die with dignity, has been locked in a 13-year legal battle with Terri's parents and siblings who argue Terri is alert, wants to live and, given appropriate therapy, can be rehabilitated. Terri left no written directive.

Within hours of the state legislature's historic passage of a measure, known as Terri's Bill, which empowered the governor to take executive action in the matter, Bush ordered the feeding tube reinserted last night.

While hailed as a "miracle" by Terri's sister and other supporters, the surprise development – coming on Day 7 of Terri's judge-ordered starvation – angered right-to-die attorney George Felos, who represents Michael Schiavo.

Felos called the eleventh-hour law and Bush's subsequent intervention "absurdly unconstitutional" and maintains Terri has a right under the Florida Constitution to not be kept alive artificially.

"The governor of the state of Florida does not have the right to trump a patient's personal choice," he said at a press conference. "The citizens of Florida should be alarmed by what is happening. What is happening here is a gross and illegal intrusion into the private liberty of citizens. ... This is not the former Soviet Bloc where you don't have the liberty to control your own body."

Following two unsuccessful attempts by Felos to get circuit judges to block the reinsertion of the feeding tube, Terri was transferred from the hospice where she has been a patient for three years to a local hospital and rehydration efforts were reportedly launched.

"She was literally absconded from her death bed in the middle of her dying process," Felos told ABC's "Good Morning America" this morning, calling the rehydration efforts "cruel."

But Dr. Jane Orient with the Association of American Physicians and Surgeons, or AAPS, claims the opposite is true: "Dehydration is a cruel, painful death."

"It is unconscionable that the state ordered removal of her feeding tube in the first place – it's nothing less than state-sponsored euthanasia," maintains Orient. "She is not dependent on advanced medical interventions. Nothing is mechanically pumping her blood, or forcing oxygen into her lungs. She is simply being fed through a gastrostomy tube."

Last week the General Assembly of the Catholic Medical Association passed a resolution that concurred with Orient's view. It declared removal of Terri's feeding tube "without first undertaking rehabilitation therapy to ascertain her ability to swallow and digest nourishment" constitutes "depriving her of life without due process of law," according to Florida Statutes Section 744, 3211.

Would we allow a retarded child to be starved to death?" queries Orient. "Where are the 'compassionate end-of-life' groups such as the Robert Wood Johnson 'Last Acts' initiative, and why aren't they weighing in on this?"

Multiple physicians solicited by the Schindlers believe Terri, who vocalizes, laughs and appears to respond to her parents, could be rehabilitated to some extent. Some have even offered pro bono treatment, even though Michael Schiavo was awarded nearly $1.5 million dollars in malpractice suits to pay for Terri's rehabilitation and nursing expenses shortly after her mysterious collapse at home in 1990 during which oxygen was cut off to her brain for several minutes.

WorldNetDaily has reported that during court testimony last year, Victor Gambone, Terri's attending physician hired by Michael Schiavo in 1998, testified he was unsure whether his patient had even had her teeth cleaned in recent years and said she hadn't received therapy. He said he accepted Michael Schiavo's word that therapy had been deemed unnecessary.

"Although severely disabled, some believe that she does have the capacity to communicate a desire to live. The husband has obstructed efforts at rehabilitation or independent assessments of his wife's true state," continues Orient.

WorldNetDaily reports the family has been blocked by Michael Schiavo from visiting Terri at Morton Plant Hospital in Clearwater, Fla., where she was transferred. Their inability to verify she is being rehydrated per Bush's order concerns them. As of yesterday morning, they reported she was awake and appeared alert, although shrunken.

Felos told reporters yesterday Terri was showing signs of massive organ failure and said the reinsertion of the feeding tube was just prolonging her death.

AAPS, a non-partisan, professional association of physicians dedicated to protecting the sanctity of the patient-physician relationship put out a warning to colleagues: "The ethical question for her nurses and physicians is whether they will cooperate in carrying out a death warrant.

"And the ethical question for all of us is whether we will allow the state to obstruct the efforts of people who want to provide medical care to a patient who wants to receive it," said Orient. "If we go down that path, who's to say what treatment the state will prevent you from getting?"

-------------------End of article-----------------

A note from me! Please act to save this woman. Something is terribly wrong with this case. It is NOT compassionate to kill someone who had NEVER been given the chance to rehabilitate. She breaths on her own, she responds to love and she has suffered at the hands of a husband-living with another woman, of course-who wants her dead. It has never been about Terri's wishes...no man who loves his wife would have EVER done what this man has done to this woman.

Please look into the background of Felos-Micheal Shiavo's attn. This horror of a man is associated privately with the Hospice of Florida assc. and is a member, himself, of the hemlock society. Judge Greer is ALSO associated with that hospice. Terri's parents love her and want to GIVE HER A CHANCE.

A hospice is NEVER supposed to terminate a life that is NOT terminal, especially if that life has not had that CHANCE of exhausting EVERY means of rehabilitation. What Terri's husband has done to stop rehabilitation will break your heart. Please read up on it.

Felos and Micheal and the Woodside hospice deserve to have a major lawsuit rolled against them if Terri is murdered.

Michael and Felos want Terri stuck at the hospice because they can DENY her every therapy available while in a hospice, and also can ORDER the doctor there, as to what to do and not do for Terri. It is a hellhole for Terri-who is not terminal. DID YOU KNOW THAT MICHAEL KEPT TERRI FROM HAVING HER TEETH BRUSHED ACCORDING TO MICHAEL's chosen physician for Terri for who knows who long, but the estimate is TEN YEARS????

Terri must have quite a story to tell about Michael and her 'accident' if she has striven to stay alive in the hell Michael has put her through for SO LONG.

It is pretty obvious that Terri WANTS to live!

But it is definitely obvious that Michael and his attorney WANT Terri dead.

< to bill press >

Well, if you got this far before your sanctimonious, shallow, creepy mind went numb from having to understand that every story has two sides and that looking at both is the only way to determine where the truth falls.....then, thank you. Maybe. Just Maybe. You grew. Try investigating before you spew your devastating opinion. You'll feel better and your public will get the full nine yards.

YOU ABSOLUTE HORROR! Did you not know that Terri has HAD NO THERAPY for TEN YEARS?????????????????????? Did you not engage in even ONE ounce of research? Bobby Schindler cited the statute of limitations, but last night Mr Schindler Sr said they had refused to investigate. I am glad an investigation is underway now. I don't see how MS/Felos can get the tube removed with the ongoing investigation into abuses over the last 10 yrs. The investigating agency gets to see all the medical records and all pertinent information. I pray they see what is so obvious to the rest of us & MS is removed as guardian.
