I hate to say this, but the only way this gets any traction is if, and this is opinion, Scalia initiates this through the WH.

He's going to have to walk in to the Oval Office and say, "This needs to be dealt with."

If not Scalia, you'll have to find a Senator or very powerful House member to take this to GWB.

If GWB makes it an issue, it will be an issue.

Right now, the base will vote R despite O'Connor.

I suspect that this will get more traction after Nov 2004. If the Senate and House pickups are as predicted, then it will be a different ball game, and R strategy will shift to preventing legislation by judicial activism, which will literally be the only avenue left to D's in terms of their influence.
