"They still need 51 votes for the nuclear option, and they don't have them." Do we have a listing of the DirtyDozen RINOS who refuse to go nuclear?! They oughtta be exposed and targeted fer a major ration of $#!+ from their constituents, imho...MUD

The senate should just have a vote--forget the rules, just vote. What are the dems going to do--go to court?Ummm...yes, they could very easily go to court, and they would win, and they would be right, and we would come out looking like jackasses at the very best.

That's what I don't understand. This "filibuster" isn't preventing a vote. Hold the damn vote. You can't call a vote while a speaker is holding the floor.

What's to stop the GOP from just popping in at 1:00 a.m some night and voting? Obviously I'm not real hip on my parliamentary procedure.

NO! The nuclear option does NOT require 51 Senators. It only requires a "majority of the Senators present and voting" to uphold the ruling of the Chair that the filibuster cannot be applied to judicial confirmations.
As long as a quorum is present (which is 50 Senators minimum), then a majority vote, even 26-25 assuming the Senators tie at 25 and Cheney casts the deciding vote, and the deed is done. The planning has to be VERY precise, but the best opportunity will be late on Friday or early Saturday morning when four Democratic Senators are on their way to Iowa and cannot back out of that trip.

Hmmm...... If there isn't 100 senators in the chamber wouldn't the number then be less than 60?

The Democrats are really closet racists. They believe in holding their friends close and their enemies closer. As long as they are coolade drinkers, the Democrats will support them (but not at a level where they have any real power, just perceived power). If they are not coolade drinkers, then the Democrats vent their racist hatred against them. It is amazing how many minorities (racial and religious) don't realize that the Democrat insiders hate their guts. Maybe some do understand but cash talks and a better country is not on their priority list.

The rules are set the way they are because we don't want bad laws made from bad news. Knee-jerk legislation and all that. Unfortunately, if the rats are willing to filibuster judicial APPOINTMENTS [not called nominations in the Constitution, note], then rest assured, the rats are willing to change the rules any way they like if they ever regain power. There's no reason to play nice. So long as the rats are in the Top Two parties, it's never, ever going to be business as usual in DC. Perhaps when a third party replaces the rats, then you can return to civility.

"It is amazing how many minorities (racial and religious) don't realize that the Democrat insiders hate their guts."
And with all our muzzle laws that keep racists undercover, the rats ensure that only an idiot like Byrd would occassionally and briefly screw up in public. They like keeping a muzzle on racism. I point out to friends of mine at work [white and black alike] that giving a racist freedom to 'be himself' is giving that racist enough rope to hang himself with. Otherwise, he will stealthilly stab his 'friend' in the back. Which is worse? It's obvious when you think about it. Laws are such that minorities can only guess what a white guy is thinking. That makes us more sinister than we should be.

One problem. The intent of the US Senate was not to serve the interests of the people, that is what the US House is for. The intent of the Senate was to serve the interest of the STATES. It started downhill when US Senators started to be elected by popular vote, which should have never happened.

I like better portraying the Democrats as "anti-choice" on voting for judges.
