Grand Jury Calls For Removal Of Circuit Clerk
Little Rock - A special Grand Jury calls for the removal of Circuit Clerk Carolyn Staley Thursday. The question, what will it take to remove her from office? It all started six months ago. That's when the Grand Jury started investigating problems with the Pulaski County election system. Now, it's up to the Pulaski County Prosecuting Attorney and a Circuit Judge to decide if Carolyn Staley should be brought to trial.
Channel 7's Beth hunt reports:
Staley's attorney, Blake Hendrix, says the Grand Jury's findings are mere allegations. After years of voting problems and months of investigation, a Grand Jury calls for the resignation of County Clerk Carolyn Staley. Election Commission Chairman Jerry Larkowski testified before the Grand Jury Thursday morning.
[Jerry Larkowski, Pulaski Co. Chairman Commission] "It's a sad day for Ms. Staley personally. But this is a step in the direction to get this."
Based on the Grand Jury's findings, Staley is accused of incompetency, misfeasance and nonfeasance in office, which is improper and unlawful execution of an act that in itself is lawful. In a phone conversation Thursday night, Staley's attorney, Blake Hendrix, said Prosecuting Attorney Larry Jegley "controlled and presented what evidence he felt should be presented. In a Grand Jury situation, the target has no right to testify and no right for counsel to be present. Jegley had no obligation and did not present evidence favorable to Staley."
Hendrix went on to say, "Carolyn is obviously upset, but she has the absolute right to defend herself, and I suspect she probably will defend herself and defend herself vigorously."
Prosecuting Attorney Larry Jegley has the burden of proof, so he will have to present this to the Circuit Judge who will in turn decide whether to call the trial.
We'll certainly be following this story and will let you know what happens.
SS. Should be Palm Beach County.
