THE PERSECUTION OF RUSH GOES ON MARK A SITY 12/26/03

Years ago, Brett Favre had a problem with pain killers. He was buying them illegally after a prescription ran out for after an injury that still hurt. He became addicted. After the news came out, he apologized to his fans, went into treatment, and all was right with the world. Not a soul seems to be interested in investigating Ozzy Osbourne’s drug use, but there might be a reason for this. Ozzy seems to be attempting to prove the theory of evolution by devolving into lower forms of life before our eyes. Ozzie is an interesting scientific experiment.

Yet, Rush Limbaugh is reported to have a problem with an addiction to pain killers, admits it and goes into treatment, and all is still not right with the world. Rumors are reported first that he’s part of a drug ring investigation. Ok, it seems this is true in that his name turned up as a customer. Then rumors were reported that he was buying these prescription pain killers in 1000+ lots. Then rumors were reported that he was involved in selling the drugs (like he really needs the money!). Then it was money laundering. Now he is under investigation for the very serious crime of “DOCTOR SHOPPING”. It seems this is a huge crime in Florida.

This makes me wonder. If I take my family to Florida for a vacation, and our daughter hurts herself, let’s say she hurts her leg. Being from Wisconsin we wouldn’t know who the good FL doctors are and who the quacks are. We’d probably take her to the closest doctor. So let’s say we get Dr Quack. Dr Quack takes her into the X-ray room, and comes out with an X ray showing a hairline fracture in her calf bone. We would assume a leg cast is in order. Dr Quack comes back with not the plaster cart, but a laughing gas cart and then pulls out a big meat saw. Dr Quack tells us he will have to amputate her leg for the hairline fracture. If we decide to take her out of the office (with both legs attached) and look for a second opinion are we in violation of FL law for “DOCTOR SHOPPING”?

I don’t claim to have any inside information on Rush’s situation, but drawing on what he has said, it seems that he had a painful back problem and went to Dr Quack. Dr Quack recommended surgery. Dr Quack messed up the surgery. Dr Quack prescribed a pain killer to Rush for temporary relief of a long term problem. Dr Quack’s prescription ran out on Rush, leaving him in debilitating pain. Rush knew the pain killer could allow him mobility, and Dr Quack offered no option other than permanent debilitating pain for the rest of his natural life. It seems to me that Rush should have been “doctor shopping” a long time ago!

Why is Rush on trial here, without even any charges being filed? Shouldn’t Dr Quack be the one being investigated for leading an innocent victim down the path of lawlessness and drug use? Where is the AMA? Could it be that they, along with the press have an anti-Rush agenda? Nah, couldn’t be. If I believed that I’d be one of the black helicopter conspiracy types then, wouldn’t I?

This whole attack against Rush is idiotic. Rush has not missed a beat and has not hurt anybody but himself. When the commander and chief's brother ( Rodger) has been quoted as saying his brother has a nose like a vacuum cleaner I think this ram rod of Rush is a joke.

They sought treatment, and in the case of Favre and Perry, that seems to be the end of the legalities, but not in Rush's case. Of course Favre and Perry didn't have a demo hack Palm Beach prosecutor to deal with.

I am aware that those facts are similar. I was specifically wondering if how the drugs were obtained are similar?

You know as well as I do that if this were Clinton or Gore or a Hollywood pinko, they wouldn't be prosecuted for anything, let alone the specious charge of 'doctor shopping'. The court of public opinion is one thing, and yes, anyone on the left would take a beating here.

It does appear that some on this forum are far more concerned that Rush gets nailed rather than HOW he gets nailed.

Many are claiming his defenders would have a different spin if he were a liberal.

Psychologists call it "projecting", I believe.

The ones that are squealing about his defenders' alleged "hypocrisy" would most certainly go off the deep end if a liberal were to receive this kind of treatment from a prosecutor.

Fortunately for the libs, history has shown it rarely happens to one of their own.

Rush was taking the drugs prescribed to another. He has already admitted that. He is a Law-Breaking Doper.

He is a "short-haired, dope-gulping, vermin-free, A.M. type"

Rush Limbaugh knew exactly what he was doing. His addiction could ruin him. I am sure he faced the fact daily that anyone could find out and ruin him. He had the money to continue his pill popping. He may have even had to have a drug screen before that enormous EIB contract was signed. He went through the motions of quicky rehab and it failed. He knew that political enemies would love finding out about his problems. He took a chance. He knew the rules. Now he is in a corner. I do think he is being singled out by the people he finds most repulsive. Liberal Democrat lawyers that may have worked with Janet Reno...........Yikes.

They may have no case at all. They will make him spend a fortune on lawyers. They will put him under stress and hope he relapses. All addicts get the substance they abuse somewhere. It is not often that prosecutors spend time and resources chasing after this type of violator, unless it can be politically helpful. Rush knew it. I have one question. How did he play so much golf on that crap?

This is a new one on me. When did this come out? And if that's the case, then it would seem the prosecutors have a case that might hold water better than doctor shopping.

I'll tell you what I think is going on here: They know they don't have any case, but are going to use their power to trash him as much as they can. Prosecutorial misconduct is an ugly thing, one we should all stand against, no matter who the defendant is.

Medical records are treated differently. They get them through subpoena, not search warrant.

Thanks for the clarification on the procedural point. In any case, the point is that they can indeed get them, right? Everybody's going on about privacy, but you don't have much privacy when you're the object of a criminal investigation.

You're living in a naive, dream world if you can't accept the fact that liberal prosecutors will treat Rush differently. Rush might go down if his sleazy, Liar for Hire, Roy Black can't get him off.

In his pre-drug induced condition, Rush always said Democrats are thugs,and now they're going to live up to his expectations. If you and he ever come out of denial, you might realize that he has no one to blame, but himself.

But if they get them by subpoena, they have to have a hearing at which time the defense has a chance to present their objections. The prosecution did an end-run around that.

What are you talking about? All of my posts are about the different treatment he is getting, and that's what is wrong with this whole affair. It's one thing for the left and for tabloids, etc to rough him up, it's another for the prosecution to aid and abet that.

And in the vast majority of the cases a first time non-violent, non-trafficking addict who admits his/her addiction and seeks treatment gets probation.

Read my #70, I agree it would be the honorable thing to cooperate, plea bargain and likely get probation (if he did indeed doctor shop). But probation means conviction, and Rush is trying not to let it get that far, whining about persecution all the while.

I read the transcripts and found BOTH sides of the argument intriguing and persuasive.

Refer to post 155. If ever there was man man who is a hypocrit it is Rush. He should take his medicine and move on.

Maybe Rush is using his "back" problem as a smokescreen for his addiction.

Persons caught up in addiction do tend to look for every excuse under the sun before blaming their problems on themselves. Especially those who go on an on about personal resposibility and pulling one's self up by your own boot straps.

It looks to me like you have a pretty good handle on this issue . All this is in a nutshell is prosecutorial activism and dodging the Florida State Constitution .

If the target was not Mr. Limbaugh this would not have ever made the news . I'm just pleased to know that at least this time they are trying to nail a man who has the ability to defend himself .

If there was a spirit of cooperation, i think it's damaged when the prosecution leaks everything to the press. How far should Rush cooperate in that environment?

I've wondered about that myself. I gave the game up because of back problems. I think the "pain" is likely to just be the excuse every addiction prone person needs to justify his addiction to himself and others.
