Supreme Court won't block TEXAS GOP's redistricting plan.

WASHINGTON - The Supreme Court refused Friday to block a hard-fought Republican redistricting plan in Texas that could cost Democrats as many as six seats in Congress.
The justices will announce later this year whether they will consider an appeal from congressional Democrats and others who claim that the map dilutes minority voting strength. In the meantime, they rejected an emergency appeal that sought to stop the state from using the new boundaries in this year's elections.
The districts were approved by the Republican-controlled Legislature in a special session following months of partisan bickering, highlighted by two out-of-state walkouts by Democrats.
Republicans contend they could capture as many as 22 of Texas' 32 seats in Congress, up from the present 16, under the new map, which was upheld last week by a federal panel.
The three-judge panel said critics failed to prove the plan was unconstitutional or illegal, but noted they were not ruling on the "wisdom" of the plan.
"We know it is rough and tumble politics, and we are ever mindful that the judiciary must call the fouls without participating in the game," the judges said.

Thank God. I guess the four ultra lefties on the Court felt that they couldn't count on O'Connor so they didn't grant Cert.
Unfortunately I'm going to be stuck with Rat Chet Edwards as my CongressCritter.

The legislature did a good, careful job of redrawing district lines.

It never was in doubt. The Justice who made the decision not to grant the stay was Scalia.
I can't wait to hear the Rats whining, although I know exactly what they'll say.

It's still not over in the Supreme Court. All that happened this afternoon was a ruling NOT to issue an emergency order which would have kept the old districts in place.
The arguments that the Rats have could still be heard (and possibly upheld) by the Supreme Court later.
As a practical matter, though, this means that the 2004 elections will take place under the new map, no matter what, and a whole bunch of Democrats are going to find new jobs.
