Suppose her health is affected by his cologne. Does she have the right to get an injunction against him?

Where does this end? How far do your property rights extend beyond your property?

She rents, he owns. She's already accepted limitations from the owners of her unit on where she can smoke by agreeing not to smoke indoors. I'll bet she is instructed by the court to smoke a specified distance from the neighbor's door.

She needs to file a countersuit about the offense of the smell of dog poop lingering on the air for 4 hrs after the poop pick up. Also cat poop is loaded with shedded virus, CMV at the top of the list.

So you would be siding with Zangrando for protecting his own property rights against intrusion by Kuder's activities (which, apparently, are currently extending into Zangrando's property)?

There is a HUGE difference between allergies to perfumes/colognes (which I do have) and being subjected to inhaling toxins from cigarettes, which can cause major lung and or other respiratory problems. My allergies can make me sick (throw up), light headed and nauseated, but smoke can KILL - someday go check in on someone who has COPD and see if you want to get that.

You smokers are the militant ones.
