It is a legal product. Just because you don't smoke, you don't see a problem with not being able to smoke OUTDOORS? What if she had a pet and the neighbor is allergic, should she be forced to get rid of her pet?

I smoke, and I always go outside. I don't even smoke in the designated sections of restaurants. I feel sorry for this jack@ss Zangredo because I've worked with many patients who have breathing problems, and there's nothing worse than having to fight for air, but this guy needs to address his hypersensitivity to smoke(and oddly no sensitivity to pet dander) on his own. It's his problem, he should either move to the Arctic Circle or a non-smoking building.

Maybe I am old fashioned, but I thought our freedoms included being smelly and stupid without our neighbor's interference.

Unless the wind carries the smoke up and then down right next door, I tend to think this man is a jerk. How many fireplaces in the neighborhood? How many grills? Does he cook on a grill? Has he taken any neighbors to court who cook on grills?

I would bet this is not the first issue he has had with this neighbor.

I have two homes. A condo in the city; a house in the mountains.

In my condo halls and sometimes wafting into my apartment, I smell cigarette, pipe, cigar smoke, cooking foods, burnt foods, chemical sprays...in the garage, I smell exhausts from the cars...and because I live on a waterway, I smell fumes from the boats passing by.

At my house in the mountains, I smell all kinds of things that my neighbors choose to burn...many things that would be banned in the city.

The worst is people who wear colognes, perfumes and after shaves.

I am chemically sensitive and most all of the above make me sick. I would love it if you would help me sue them all so that I could breathe fully once again. If you agree, please send $1000 to the People for the Ethical Treatment of Humans, c/o debg at FreeRepublic.

That's not the issue at all, the people are complaining that when they leave their house, the smell bothers them.

I hate the smell of night blooming jasmine, and I am allergic to it, do I have a right to sue you if you have night-blooming jasmine growing in your backyard?

I am also allergic to cat dander, and it causes me to have difficulty breathing if I smell it.

If you and I lived next door to one another in an apartment building, should I be able to legally force you to get rid of your cats if I can smell their dander when I walk by your window?
