While I don't agree that it's right, I think it probably falls under the same premise as being able to exclude children, pets, waterbeds, etc.

You can exclude pets, cigs, waterbeds, as long as you apply the restrictions to everyone. DO NOT refuse to rent to people with children, unless you are running a senior citizen community. It is against federal law to discriminate based on familial status.

Most of the apartments and homes for rent in my area stipulate non-smoking,but I'm in Massachusetts so what else would you expect.
