Michael Schiavo accused of contempt of court
Family of disabled woman files motion of contempt in response to husbands withholding of medical information
Clearwater, FL February 24, 2004: Today, the parents of Terri Schindler-Schiavo filed a motion in the Sixth Judicial Circuit asking that the court hold Michael Schiavo in Contempt of Court for disobeying a 1996 court mandate that orders him to divulge changes in his wifes medical condition to her parents.
During the beginning of the week of February 16, Ms. Schiavo had experienced a bout of vomiting. Upon learning of her condition, her parents asked nursing staff and Hospice staff working at Park Place Assisted Living Facility in Clearwater, Florida what had caused their daughters illness and what was being done to treat her. The Schindlers were told by the staff that they could not divulge any information by orders of Michael Schiavo.
Tuesday, attorney Patricia Anderson filed a motion seeking Contempt of Court charges against Michael Schiavo.
In 1996, a court order from the Sixth Judicial Circuit, directed Mr. Schiavo to disclose any changes in Terris medical condition to her family.
Additionally, a court order in September of 2003 directed Mr. Schiavo to give a discharge summary from Morton Plant Hospital to Terris parents. As of this writing, he has yet to comply with the order.

I hope they get that rotten HINO (Husband In Name Only)and he spends some time in jail for Contempt of Court. He hasn't filed the annual guardianship papers with a Guardian Plan for over 3 years now and Judge Greer just keeps giving him continuinces.
Terri's Family have to fight this monster adulterer at every turn. It will be interesting to see how the Florida District 6 Judges Rule on this Motion.

#1. Do not get your hopes or blood up on this motion. This is typical procedural matter.
#2. Do not make an even worse mistake of only looking at one side's filings in a matter, especially lawyer's motions.
Remember, lawyers swore that O.J., Michael Jackson, the Menendez Brothers, Charles Manson, et. al. were all innocent.

You said it! This makes my blood boil. MS the HINO is getting desperate. Evil to the core and his attorney Felos is even worse. I wish the Florida courts would remove the HINO from having anything whatsoever to do with Terri.
I also read today that Terri's parents' attorneys want to question the HINO himself, his mistress and some of his relatives.
Go get 'em!!!

you remember me as the guy who's suing the pure living daylights outta the local police dept in Theresa "Terri" Schiavo's area for not "upholding" the law and protecting her! (Mickey baby committed 2nd and 3rd degree felonies this past October for going above court orders regarding the feeding tube -and denying food and meds -and rehab too.)

A lot is being said about Mel Gibsons film, The Passion, but what really is the meaning of The Christs crucifixion? How could this act possibly save a world? If it was so important, then why wasnt Jesus crucified as a child?
Answer: We needed an example to show us that life wasnt hopeless, and He was the only one.
It was His sinless life, not His gruesome death, that saved us. (The death was the result of our refusal to accept His ways.) His resurrection is another example: We can be raised when it is time.
In short, if even God incarnate were unable to live a life without depression or sin, then we
would be toast. We needed that encouraging example. Thank you Mr. Jesus!
Let US make man in OUR image (plural)... (Genesis 1:26)
They made us, thus they can answer in prayer and repair us.
One of them came among us, to show us BY EXAMPLE, and we dont get saved by works any more than our parents love us for being good. Conversely, we are good kids, by the
help of our parents; and, we are saved by the acceptance of our heavenly father. So, while we dont get saved by works, we do good works by being saved, a free gift, yet we must remember that, once saved, faith without works is dead, in the same way a job without work results in you getting fired!

You may be right: Remember I am only human.
However, the point I was making (whether I got it right or not) was that it was the entire package that was needed for our salvation (birth, spottless life for an example, death, ressurection, assention to be our righterous Advocate, as First John 2:1 says, etc.)
I.e., The shed blood and death alone was not enough -or else he woulda done that as soon as being born!

Procedure for contempt.
1. File Motion for a Rule to Show Cause. IOW. A request for the judge to rule on why the responding party should NOT be held in contempt.
2. IF THERE IS a finding that the responding party WILLFULLY AND CONTUMACIOUSLY disobeyed a court order (must have both) the judge will find the party to be in contempt and determines the penalty. HOWEVER, the Judge must afford the responding party and opportunity to PURGE the contempt. Depending on the nature of the contempt found, they usually get 10 or so days to fix whatever.
3. IF after the time pases and nothing is done, the judges contempt stands and the penalty kicks in. It can be jail, money, stiking of pleadings or any combination. (Stiking pleadings is fun because it is as if the other side never filed any papers at all, their pleadings are struck from the file. Doubt it will happen that way.)
4. It is not easy to get a contempt, it must be SOLIDLY proven and even if proven, the offending party must ignore the purge opportunity. So even if in contempt, a chance will be given to fix the offense.
5. In civil cases, sometimes you need to repeat this process a few times. If it is repeated enough, the juge can POSSIBLY skip the purge part due to ongoing disrespect.

You mention that you are suing the local PDs for "for not "upholding" the law and protecting her." I seriously doubt that the courts will give you standing in this matter, unless you are some relative. Secondly, there is no Constitutional right to per-incident police protection. A lawyer would have told you that. Next, in your comment above regarding 2d and 3d degree felonies, you have placed yourself and more importantly FR at great risk. Libel is a serious tort. The husband has not been charged or convicted in any court. For you to accuse him, and more importantly, for you to post that on FR, opens both you and FR to huge financial liabilities. Before you start suing people or accusing them of felonies, be smart; get a lawyer. If some law enforcement officer or the husband decides to go after you, at a minimum, you will pay tens of thousands of dollars in their legal fees.

Well said.
Too many of Terry's supporters have projected their untrained opinions into this story, to her detriment.
This is not in any way to demean their dedication, but when you have non-lawyers interpreting motions and rulings (and getting it wrong), space cadet para-psychologists diagnosing her by telephone and 10 different people claiming to represent her and her best interests all giving conflicting interviews to the media, allegedly on her behalf, chaos results.
It's not enough to just want to help. Well-intended but untrained people kill injured victims when trying to give first aid at accident scenes. Untrained but well minded people have hurt Terry's cause, too. Unfortunately, through no fault of Terry's, the case drew out many members of the local Loony Brigade, and soon, the public began to associate Terry with them.
Rule one for accepting volunteer help in critical situations: "If the person hasn't been paid to do the particular task in the past, don't let them do it for free when someone's life is on the line."

Dear Mr. Ackuman:
Many of us are concerned about Terris well being. Her husband Michael Schiavo has been on a decade-long quest to have her starved to death.
We would like to be assured that Terri is safe in your facility.
We understand that recently when Terris parents inquired about her health and well being (the vomiting episode), they were told that your facility would NOT give them any information on orders of Michael Schiavo. I understand that he is being accused of being in contempt of court regarding this matter.
Could you please put our minds at rest that you will make sure that Terri is receiving the best medical care possible that you will not allow anything bad to happen to her that you will protect her from attempts to harm her by her husband that you will speak in a compassionate manner to Terris parents that you will treat Terri with dignity and concern.
Thank you. We are trusting that you will make sure Terri is safe while she is in your care.
