Has Same-Sex Marriage Eliminated The Estate Tax? (How's this scenario....)
Lord Knows | March 1, 2004, A.D. | jigsaw

Posted on 03/01/2004 4:52:12 PM PST by jigsaw

Your Mom and Dad have a ton of money, and much of it will be hit with heavy estate taxes when they both pass on.

So, let's say your Dad dies, and your Mom has all the money.

Now, if marriage is going to be defined as an agreement between consenting adults, simply marry your Mother. She does love you, doesn't she? And you love her!

You become her husband. If necessary, she can legally disown you as her son.

When she passes on, her estate, which you share as you're married, will go laterally to you, her spouse, rather than vertically between generations.

Of course, if your Mom predeceases your Dad, simply marry your Dad. Same-sex? No problem!

Heck, marry them both.

Bigamy? Oh please...that's so discriminatory.

In fact, get married to your own children too so you have a family not of parents and children but solely of spouses.

Any attorneys and tax accounts out there who want to weigh in before I call my widowed Mother?

Um, there's a teensy, weensy problem with this. Even states like West Virginia have laws against marryin' yer Momma. Other than that minor detail, it's a cute idea.

Hmmmm... I recall posting nearly these same words a couple days ago. I suppose larceny is a universal language.

Yeah, yeah. And in California, they have laws against same-sex marriages.

The Rule of Law is so........three weeks ago.

hmm, i didnt realise that same-sex marriages also made marrying your parents legal.

No, same-sex marriages have not made marrying one's parents legal. However, accepting the rationale for recognizing same-sex marriages necessitates abandoning the rationale for not recognizing marrying one's parents.

In the event, the courts may not actually end up legalizing parent-marrying, but that will have only made them inconsistent on these matters.

And the state California has (had?) a law against marrying someone of the same sex as yourself.

Things change.

I wasn't accusing you of plagerism, just sharing an obvious thought about new tax loopholes. I believe I got around the possible divorce problem by simply having a group marriage of all family members.

If not giving same sex partners benefits is wrong, how can you possibly justify denying any other relationships?

It's the same teensy, weensy problem as the gay marriages in California. That's against the law there too.

This all seems very funny but actually represents "the law of unintended consequences". Redefining marriage has huge implications in laws, finances, taxes, etc. Big business ahead for enterprising accountants and lawyers!
