First, info is so sparse it's difficult to know yet if Tyrone Marshall (or his so-far unnamed accomplice) had any connection to Kerry's VVAW comrades. One of the bullets narrowly missed Stennis' heart.

Second, even if there is no connection, Kerry never reported the Phoenix Project to the authorities. Had he done so, presumably Senator Stennis would have been warned and had the opportunity to take proper precautions.

Those precautions themselves might have thwarted this shooting.

He knew of the upcoming attacks but didn't report them to prevent them. He allowed Senators to possibly be killed.
