The attorney for accused terrorist Zacarias Moussaoui said yesterday he won't decide for at least a week whether to ask the full 4th U.S. Circuit Court of Appeals to reconsider Thursday's ruling by a three-judge panel.

"It's a tough call for us because there's so much in the opinion that we like, that we might be hesitant to risk some victories that we've already gotten to try to squeeze a little more juice out of the lemon," said Frank W. Dunham Jr., the federal public defender for the Eastern District of Virginia.

This is a most interesting decision from the point of what constitutes an "open trial", "the right to face your accusers", "the right to cross examine witnesses", "right to present evidence in your own defense".

It is indeed difficult to balance the various interests in this case, the rights of the accused and the national security concern. But I guess I won't be able to read the whole decision. You can only read it at the courthouse. That too is extremely unusual.

A non-American enemy combatant discovered on our soil in the midst of planning an act of war against our country.... I don't see why he should be allowed to "appeal" squat.
