Lesbian couple wants San Diego country club to treat them as spouses

SAN DIEGO (AP) - Late in the day, when most others have cleared the course of rolling hills and serene lakes, B. Birgit Koebke, golfs alone at her country club. If a group happens to be ahead of her, they no longer allow her to play through.

"I just sit there and wait," she says. "They've made it impossible for me to enjoy the club."

Koebke, a 47-year-old television sales executive, is a longtime member of the Bernardo Heights Country Club. She is also lesbian, and her extended drive to win club golfing privileges for her partner of 12 years, Kendall French, has left few members willing to play with her.

Koebke hopes the California Supreme Court will hear her argument that the state's civil rights laws should require the club to give French, her state-registered domestic partner, the same benefits given to spouses.

Trying to use government force to ensure the private organization bends to her desire. Sounds like a couple of Freepers I see with the same desires.

Forget about the issue of what kind of sex this gal likes. She wants married benefits yet the law says she is not married. If the club grants her married benefits they will have to grant married benefits to anyone else who claimes they should have them - unmarried couples living together, couples who are dating, former spouses, etc. The law defines her as "unmarried."

THere are pros and cons to this issue...in rfeality, it's not about discrimination, or sexual orientation, it's about a club being able to limit membership to people who enjoy each other...25 years ago, a cc membership belonged to the male, only..his wife and children were part of his family..If HE died...the widow was often no longer welcome..the membership lapsed..odly enough, the other wives were the ones who wanted this...they didn;t want single women around..then, some clubs allowed widows to have associate-type memberships..Thenm when the divorce explosion began in the 70's..with no-fault..women sued,a nd won, to not be excluded...what usually happened in a divorce,the wife and kids stayed inthe house, in the burbs..the male moved to the city, or to another town..now, because divorce is so rampant, and because golf memberships are so scraece, and hard to obtain..we have a long waiting list...we have several formerely married couples who are now BOTH members.., and with new spouses...and on, and on..so,if this female couple....were granted equal status,and THEN they split up, and BOTH wanted to stay, and bring new spouses..well...like rabbits...

As someone very involved in the operation of a private club (as a member), I can tell you that the government can wield a lot of pressure...threatening the cancellation of liquor licenses, threatening the cancellation of leases, enforcing anti-smoking restrictions by legislative fiat, threatening extra scrutiny on construction permit applications, workers' comp claims, etc. It's very intimidating. Of course, all of this happened to us under a RAT adminstration.

If this is a private club .. I don't think the court can force the club to admit members who are not based on the clubs rules.

Remember the golf course in Agusta, GA. The club is for men only. They still do not admit women. This case can set a great precedent in court against having to allow people other than the STATED PURPOSE of the club.

After filing her lawsuit, Koebke says the atmosphere became hostile enough that her business clients were made uncomfortable, forcing her to stop bringing them.

Not because she was outed as a homosexual.

I'd like to scratch my armpits, go unshaven, wear slovenly clothes, pass gas vigorously in mixed company, keep bits of broccoli in my teeth, and be accepted as a social equal at the Country Club. If people keep avoiding me, I'm going to sue.

What disturbs me more was an article I remember reading a while back. It said 1 in 10 San Diegans is HIV positive. That's an incredibly scary number.

So the next time you're in a group of ten people, try and guess which one it is; it really shouldn't be all that difficult.
