WSJ: Berger Took Secret 9/11 Docs on Five Occasions

Kerry campaign advisor Sandy Berger removed secret terrorism documents from a 9/11 Commission reading room on no fewer than five occasions, his lawyer Lanny Breuer admitted late Monday night.

Breuer told the Wall Street Journal that his client, who served previously as the Clinton administration's National Security Advisor, inadvertently removed several copies of an after-action report on the foiled 1999 Millennium bomb plot during two separate visits to the top secret facility.

Breuer said also that Berger had deliberately removed handwritten notes that he had taken during three additional visits to the Archives last fall to review classified documents.

Mr. Breuer said removing those notes was a violation of National Archives policy, and that Mr. Berger regretted the action. "He knew it was a technical violation, and he admits that it was an error in judgment."

But according to New York civil rights lawyer Ron Kuby, Berger's decision to remove his notes wasn't just a "technical violation."

"You're not permitted to remove anything from that room - period," he said Tuesday morning. "And that means even your notes. If you're taking notes about classified information, those notes are now classified. They're placed in a secure area. You can have access to them only while being viewed by a security officer. Nothing gets removed."

Even if Berger had only removed his personal notes on classified material, it would still be a crime, said Kuby, who learned about classified reading room procedures during his own involvement in the trial of the 1993 World Trade Center bombers.

unbelievable - Tom Harkin is on the floor of the Senate right now spewing lies about the Bush Admin., pitching the tale of Joe Wilson, without any apparent recognition of how his tale has been blown out of credibility and now, here, another top Clinton / Kerry advisor appears guilty of lying, actually stealing damning documents from the National Archives. Now WHO KNEW and WHO LIED? Not Bush.

I'm way behind on this story.

tell me, what did he do with these documents? I know its illegal to remove them, but has there been any allegations regarding what he did with the material? whether he allowed anyone else to see them once they were un-secured by his actions?

this whole thing about "notes" is a diversion from the reality that he stole original documents and secreted them away to his house. Note the legal-ease weasel Clinton-esque wording his lawyers provided to the press, that nothing to their knowledge was withheld.

What did Clinton & Berger know and when did they know it?

That is the question.

don't forget that Clinton brought Berger & Bruce Lindsey along with him when he testified before the 9/11 commission - the media make a big thing about Bush + Cheney testifying together but that little tidbit of info seemed to have escaped their scrutiny. Now we know why Clinton brought Berger - he needed his assurance and counsel as to which documents Berger successfully stole & took to his home to be shredded before they testified.

He probablyu removed them because they were damaging to the CLinton Administration, regarding how ill-prepared they were to deal with terrorism and how they knew they should have tried to root out Al-Qaeda here in the US and failed to act.

He did it For the Children.

The Bush team's right wing attack machine clearly entrapped Berger by allowing him continued access to documents after the first accidental violation of minor technical rules.

The Hill 3/17/99 Dick Morris "…Sandy Berger is about as qualified to be White House national security advisor as I am. He’s a political operative who had virtually no foreign policy experience before he became Tony Lake’s deputy. He was put into the National Security Council (NSC) under Lake so that Tony, who didn’t have a clue about politics, wouldn’t get cut apart in the congressional swamp. His job was to know politics. Tony’s was to know foreign policy…. When Lake and Christopher left, Berger got the top NSC job, the first professional politician ever to be named national security advisor. It was a major mistake….Clinton’s choice of Berger was, however, just right for his concept of foreign policy, that it is subordinate to domestic political and economic considerations. Where the president can intervene abroad and do well at home with domestic constituencies — as in Israel, Ireland and Haiti — foreign policy is important. But where global strategy is concerned, the prime motive is economic — to create jobs in America — and not diplomatic, military or strategic. He runs foreign policy like a governor promoting his state…"

Seems he was there to help the Clinton team decide what would be turned over to the commission. I guess there were some items (hand written notes) that he thought should not see the light of day.

This whole thing was just an oversight. Just last week I was in my attorneys office and when he stepped out some papers beloging to my litigant accidentally slipped into my pants. They were loose fitting Dockers, could've happened to anyone. Didn't realize it until I got home. So I read and photocopy them bfore I returned them, in case I lost them on the way back to his office.
