Judge blasts Peterson prosecutors, strikes witness testimony

Scott Peterson watched Tuesday as a judge threw out testimony against him after prosecutors failed to follow evidentiary rules.

REDWOOD CITY, Calif. — The judge presiding over Scott Peterson's murder trial angrily rebuked prosecutors Tuesday for repeated violations of the evidence rules and as punishment ordered jurors to disregard entirely the testimony of a state witness.

"I've had it. This has been a constant refrain in this case. This is going to have to stop," Judge Alfred Delucchi shouted at prosecutors after learning they had failed to share evidence with the defense about a witness who had just testified.

The woman, Lissa McElroy, had described strange behavior by Peterson several days after his pregnant wife, Laci, went missing.

McElroy, a friend of his mother-in-law, said that when she tried to help him select snapshots of the missing woman for the press, Peterson picked inappropriate photographs, including one in which Laci Peterson was drinking alcohol and another in which a man was exposing his buttocks to the camera.

COURTROOM DRAMA

Yes, courtroom drama like I've never seen before. I'm not exaggerating. Judge Alfred Delucchi got very mad at the prosecution late this afternoon, putting his hand near the top of his head and saying: "I've had it up to here. I'm sick of this. It's annoying me …. I'm going to do something." He was so upset, one legal analyst said: "I thought he was going to come over the top of the bench after the district attorneys."

The judge is upset at yet another trial violation by the prosecution. It happened during testimony from the 100th witness. (Everyone smiled in amazement that we've reached the 100th witness, but minutes later that was forgotten and we all had a look of shock.)

Family friend, Lissa McElroy, testified that a few days after Laci Peterson disappeared, she and Scott Peterson tried to pick-out photos to show the media. Scott suggested some very inappropriate photos: one with Laci in her bathing suit, another one with Scott and his buddies, except one friend was mooning (showing his butt) to the camera.

McElroy apparently looked at some photo albums........

Aug. 3 (AP) — Scott Peterson added "hardcore" adult programming to his satellite television service in the weeks after his pregnant wife vanished, a witness testified Tuesday at the former fertilizer salesman's double-murder trial.

Donald Toy, a manager for EchoStar satellite TV service, said Laci Peterson first ordered the DirectTV service at the couple's Modesto home on March 13, 2001 without the adult programming option.

But on Jan. 8, 2003, about two weeks after he reported his wife missing, Scott Peterson changed their account to include the Playboy Channel and altered the service again five days later to include more explicit adult channels, Toy said.

What began as one of the strongest days for prosecutors in the Scott Peterson trial ended with a blistering rebuke from the judge.

In early testimony Tuesday, prosecutors had shown that just three weeks after his wife disappeared, Peterson ordered a hard-core pornography package for his television set.

But by late afternoon, Judge Alfred Delucchi castigated the prosecution team for repeatedly violating court rules and as punishment told jurors to disregard a prosecution witness who testified about an unrelated matter.

"It was a good day for the prosecution in showing what a crumb Scott Peterson is," said Terence Hallinan, San Francisco's former district attorney, who sat in on the case Tuesday. "But then the judge went and told the prosecution in front of the jury that they're even bigger crumbs."

For weeks, the prosecution has been trying to portray Peterson as being emotionless and acting bizarrely inappropriately after his wife disappeared. On Tuesday, despite defense objections, prosecutors attempted to show that Peterson .......

August 4, 2004 -- REDWOOD CITY, Calif. — Scott Peterson ordered explicit, 'round-the-clock satellite porn three weeks after his pregnant wife disappeared — but abruptly canceled the service as cops raided his house, a witness testified yesterday.

Donald Toy, a Dish Network representative, testified on the 33rd day of Peterson's double-murder trial that Peterson began subscribing to the Playboy Channel two weeks after wife Laci vanished, and tried it for four days before deciding to move on to the harder stuff: the "TENXtsy" package.

"They're adult content. Very explicit," Toy said of the movies. "You can order one movie at a time or unlimited, at your leisure."

Peterson chose the latter.

According to the company's Web site, TENXtsy "is a 24-hour, uncensored adult channel delivering the wildest situations the adult world has to offer. TENXtsy showcases movies chosen to entertain and tantalize your senses." ........

REDWOOD CITY, Calif. - Scott Peterson looked like anything but a fearful husband, ordering up hard-core porn on his TV and flashing a big, goofy grin at a vigil soon after his pregnant wife, Laci, vanished, according to testimony yesterday.

Just six days after reporting Laci missing on Christmas Eve two years ago, Peterson was photographed for newspapers smiling at a vigil.

"He was very relaxed," testified Kenneth McCall, who attended the vigil. "He seemed to be in a very good mood, joking."........

IT DOESN'T speak well for the TV news business that at noon California time, CNN made a top story that Utah's Mark Hacking had been charged with the murder of his missing pregnant wife, Lori -- in the middle of the Iraq war and a contentious political race to win the White House.

Even Internet columnist Matt Drudge hadn't rushed to report this item. The Hacking story wasn't on the Drudge Web site at noon, although Drudge did see fit to feature such headlines as: "Police drug-sniffing dog dies from overdose," "Cruise ship catering to eco-tourists spills 5,000 gallons of diesel fuel," and "Iran allowing sex-change operations."

Fox News ranked the Hacking story as its top Web site report, as CNN advertised that Monday night's "Larry King Live" would air the latest on the Hacking case.

Here we go again.

Another beautiful young white woman missing and another hinky husband -- add them together and you get another murder-trial media circus.

The same faces are back to comment. You met them at the O.J. trial. You saw them again when Chandra Levy disappeared, then Laci Peterson. They were on the case when authorities indicted Michael Jackson for child molestation and ......

I just got a new idea for a "reality-based" TV show -- "ripped from the headlines":

Every week there is a crime and a trial. We the viewers will know whether the primary suspect is actually guilty or innocent. Then, during the trial, one side or the other will screw up, and the innocent suspects will always go to jail, while the guilty suspects will always walk free.

What fun!

Turn out the lights, the party's over for the prosecution.

Scott can now begin to entertain serious offers from Hollywood agents for his story, and who knows, for proposals for hosting a talk show, dating game, etc.

At this point I need to wonder if these are screwups or intentional.

I'm not a juror on the case thank god, but nobody has convinced me beyond a shadow of a reasonable doubt that the man killed his wife.

I just hope that if he did kill her, he's found guilty, if he didn't, then he needs to walk.

I do, fervently. Murderers belong in prison or six feet under. But this one is being allowed to get away with murder by a Volkswagen Beetle-full of pinstriped clowns who apparently couldn't prosecute a speeding ticket.

Unfortunately it seems like it's already like that. The press needs to be reigned in on these cases, I doubt at this time in our history if you can get a fair trial anymore from all of the grandstanding the freakin national media does.

The circumstantial evidence is so strong. But I agree - if there is hard evidence that he offed his wife, it lies buried underneath tons of screwups and plain old human error on the part of the prosecution.

It's very hard to believe that Scott Peterson (of all people) pulled off "the perfect crime".

But the reality may well be that he didn't even have to come close to that standard.

You know far more about the case than I do. I haven't seen any evidence yet that would lead me to vote for conviction if I were on the jury.
