Lawyers for Golan Cipel, the man with whom Gov. James E. McGreevey said he had had an extramarital affair, angrily disputed the governor's account yesterday, saying that Mr. Cipel never consented to any intimate contact with Mr. McGreevey because he is and always has been heterosexual.
The lawyers, Allen M. Lowy and Rachel Yosevitz, said that the governor had subjected Mr. Cipel to unwelcome sexual advances on more than a dozen occasions beginning in November 2001, when Mr. McGreevey, 47, was elected and Mr. Cipel worked as an aide on his transition team. The governor's abusive conduct continued, the lawyers said, during the eight months Mr. Cipel worked for Mr. McGreevey, first as a liaison for homeland security and then as a special counsel.
Finally, Mr. Lowy said, the advances upset Mr. Cipel so much that in August 2002 he told the governor he had had enough. "Shortly after that, the governor pushed Golan out'' of his administration, Mr. Lowy said.
Speaking during an interview in an Upper West Side apartment, the lawyers presented their most extensive description of Mr. Cipel's encounters with Mr. McGreevey, asserting that their client objected to his behavior but was afraid to speak out publicly for fear that he would lose his $110,000-a-year job.
According to his lawyers, Mr. Cipel, 35, an Israeli national whom Mr. McGreevey met during a trip to Israel in 2000, was also worried that the governor might use the power of his office to have him deported. "The governor put him in situations, and Golan was weak against this powerful man, scared really,'' Mr. Lowy said.
Mr. McGreevey's lawyers and aides have vehemently denied that he coerced Mr. Cipel, insisting that the two men had engaged in a brief consensual affair.
Mr. Cipel's lawyers were reluctant to discuss details of the physical encounters, saying that they would reveal them if Mr. Cipel decides to follow through on his earlier plan to file a sexual harassment suit.
But they described Mr. Cipel as a young man who was flattered when Mr. McGreevey offered him a job, then disturbed when the governor began subjecting him to innuendos, sexual advances and some unwelcome physical contact.
Ms. Yosevitz said that there are witnesses who will back up Mr. Cipel's assertions, but she declined to name them.
"There is corroborative evidence," Ms. Yosevitz said. "This is not a 'he said, she said' case. There is evidence which will be damning."
But Mr. Cipel's lawyers said that Mr. McGreevey never tried to pressure their client into concealing his numerous advances.
"As far as he was concerned, he never did anything wrong," Mr. Lowy said of the governor. "He was in denial. He also assumed that Golan wouldn't say anything because he was a good soldier."
The lawyers said that although Mr. Cipel had found jobs after leaving the administration, he had suffered financially and was also depressed because of the negative publicity that had surrounded his work for Mr. McGreevey.
They said Mr. Cipel first sought to file a lawsuit because he wanted to put the matter behind him but was not necessarily interested in a financial settlement.
Now that Mr. McGreevey has announced plans to leave office on Nov. 15, Mr. Cipel is uncertain whether he will pursue his legal case, his lawyers said.
"After the resignation, Golan felt vindicated," Mr. Lowy said. "He felt that the governor's revelation was evidence of his guilt in the matter. You do not resign if you had a consensual relationship."
I guess Cipel finally got a clue when McGreevy tried to take off Cipel's pants and shorts during a homeland security meeting in the statehouse.
McGreasy's Dim aides weren't alarmed b/c McGay was always funning with the guys, undressing them, and going down before getting down to state business. Happened all the time. McSlime is such a fun guy (snicker).
