August 17, 2004 -- REDWOOD CITY, Calif. — Stunning new phone tapes from Scott Peterson's slay trial yesterday depicted his miffed mistress demanding to know if he slept with wife Laci the night before she vanished — and Peterson insisting he told Laci about their affair after their first date.

I don't think so. They, PD were investigating. Scott wasn't under arrest so, I don't think Miranda Rights were needed until they arrested him April 2003. Besides, Modesto Judge gave the okay for wiretaps. (just my opinion)

I remember some years back, that if you taped a conversation with someone one the phone, you were required to "tell" them. Not sure if that was or is a law or what.

I also remember that when anyone recorded me, there would be a beep on and off. I guess technology has come a long way. :)

The question is whether it was an illegal search. I don't know specific case law (I do corporate, not criminal), but basic principles would tell me that it was not illegal. Generally, depending on jurisdiction, a call can be recorded if one person to the conversation knows it is being recorded. Also, searches can be done if the person consents. So, since Amber consented, and she was likely (again, depending on California law) within her righhts to tape it, the tapes are admissible.

"If ONE person knew it was being recorded." Oh! Ok.

You know Garagos...........he will try and use EVERYthing he can!

I'm sure the authorities covered their bases with this before they proceded.

Boy, this Scott is one piece of work! :(

A lot probably depends on state law. In NY I know it's like that, you need to tell the other party you're taping the conversation. Private Investigators though are given a little more leeway when it comes to that sort of thing.

I'm sure. And in California, the laws are probably a lot broader.

Yes, that guy was at least loyal to his friend.

Did you hear the part about where he was in a restaurant with Amber and her brand-new baby? He got up to go to the bathroom, and when he returned, two women (whom neither he nor Amber knew) were screaming at Amber about her being a homewrecker. With the baby sitting (lying?) right there!

I believe Laci had her suspicions. If Scott is believed by the jury (ha ha, little joke there), then they will believe that Laci knew about the cheating and implicitly condoned it.

So if Laci already knew about the cheating, and wasn't reacting to it, then how come Scott had to tell very specific lies to Amber in order to have the period from late December, till Jan. 25, free, w/o seeing Amber?

It wasn't b/c his wife would be demanding his presence on Christmas and New Year's. It was for some other reason.

Have you heard or read any of the conversations? If not, I urge you to do so.

Deception comes in many forms. People lie, they steal, they steal money, they steal someone's life...

This all points to motive in a very special way.

If you aren't earning six figures, there is no way a California blonde trophy girl will give you the time of day. Scott Peterson conned Amber into thinking he was a rich man with a family in Kennebunkport and a home in Sacramento and a condo in Modesto, etc. Would Amber have had sex on the first date with a fertilizer salesman ?

Scott had always wanted a blonde trophy girl. But he couldn't afford her. To keep her he would need money. Lot's more money. Like Laci's insurance. His motive was the same as Charles Stuart's in Boston.

Common Tator..They have yet to present all their case, and of course, the defense has not presented it's case, though they were doing a great job during cross....

The jurors heard Scott yukking it up, almost giddy to his girlfriend,"from Paris near the Eiffel tower" just before the vigil for Laci, one week after she disappeared carrying his unborn child......

They will be looking at where he was "fishing" and where the bodies washed up more closely..by now there are those who hate him...It'll hang if he isn't convicted, IMHO.
