Stewart Deadline Extended Again - USSC

Yesterday the government was granted another 30 days on their extension to file their appeal to the USSC. The new deadline is now November 7th.

This is just idle speculation on my part, but...

What if the Feds are waiting to file until they see the results of the election? It's already common knowledge that several USSC justices will be retiring soon. What if they're waiting to file until they find out whether these replacements will likely be pro-RKBA or anti-RKBA?

If Kerry wins, the Feds file and hope that at least one pro-RKBA justice on the USSC is replaced before the Stewart case is heard. If Bush wins, they don't file at all.

Again, just idle speculation...

The big question would be how long would it take for the USSC to hear the case? I think you are correct but think about this. The 9th also found that the 2nd doesn't apply to individuals... If a Bush appointed USSC hears the case it may put an end to that debate once and for all in the favor of the truth and the Founding Fathers.

One delay in the filing deadline is almost routinely granted in the US SC whenever a party asks for it. This is especially true when the government asks for the delay. And bureaucracies are notorious for their inability to get things done on time.

Occam's Razor. The simplest explanation is usually the correct one. Plus, no responsible Justices would retire on the spot. All recognize that cases whose outcome might be changed by the replacement of an existing Justice, might have to be reargued. Justices normally resign with long advance notice for that precise reason.

Note though that this is the second delay. The ATF isn't known for this kind of stuff.
