Does anyone else think that the judge went back into his office with the intention to make a decision and then accidentally fell asleep?

Actually, yes. My wife was just mentioning that someone should go wake him up.

This looks promising. Perhaps the judge was expecting thsi decision sooner, and wanter to use the apellate ruling for guidance, since Daschole's lawyers couldn't provide any case law for guidance.

UPDATE: AP is reporting that the Sixth Circuit Court of Appeals has overturned the two Ohio district courts that were blocking Republican observers at the polls (story below):

CINCINNATI (AP) - A federal appeals court has cleared the way for challengers to be present at polling places in Ohio, ruling early Tuesday that their presence on Election Day is allowed under state law. A three-judge panel of the 6th U.S. Circuit Court of Appeals ruled 2-1 to grant emergency stays of two federal judges' orders Monday that barred political parties' voter challengers in Ohio.

UPDATE: The judge is being made aware of this new ruling. Everyone is still awaiting the outcome.

No; they're an hour ahead of me! I hope he rules soon though, as I would like to get to bed.

Ohio is in the Eastern time zone. Its an hour later there. But at least those poor people get to go to sleep now.

I'm Mountain Time; them poor people in the photo in Sioux Falls are Central. I do feel REALLY sorry for the Ohioans in Eastern that had to wait on the Appeals Court ruling.

Do you have any deer out there on your ranch? This weekend I am going to be hunting in Mellette County. Just have a whitetail only tag though. And there are very few whitetail in the area we hunt.

UPDATE: The judge has issued an order restricting Republicans from recording license plate numbers of people leaving the polls in Charles Mix County. Well, this is a kick in the pants for the Democrats, who wanted the judge to force the Republican Party to completely re-deploy all its poll watchers. They had no substantive evidence, they relied on Howard Dean operative who has been here for a day, they looked desperate, they didn't get the relief they wanted, the entire GOP poll watching system is still in place, and more questions have been raised about why Democrats are so paranoid about people "ostentatiously taking notes."

Some whitetail, but mostly mulies. We're in the fringe overlap of their ranges. We were visiting out of state at the wrong time this year, and I forgot to get an ap in. At least the guys I let hunt share meat. :)

I absolutely cannot believe this. I'm stunned.

Yes, but are you deeply saddened?

We are really very lucky to have found some private land near White River. There are 5 of us that go out each year. This year we all sent in together for any deer in the first season and didn't get it. So we ended up with all whitetail tags. Some of the land is right by the river and it is great for whitetail but that is only a small area. In the last few years we have gotten some really nice wall mounters. Mostly mule deer but one was a whitetail. Before we started hunting this land it hadn’t been hunted for a few years and they were growing some pretty nice deer.
