Daschle sues Thune in Federal Court

From John Fund, WSJ Opinion Journal, 11-6-2002

In South Dakota, site of the most hotly contested Senate race, Democratic lawyer James Leach wrote to Federal District Judge Lawrence Piersol last month asking if the party should file a request for a possible injunction with him since two other federal judges would be unavailable. The letter raised eyebrows because Judge Piersol is a former Democratic state legislator who was the lead lawyer in the bitter 1978 recount that won Tom Daschle his first race for Congress by 139 votes. Meanwhile, South Dakota Republicans have hinted at their own postelection challenge if the Senate race is decided by absentee ballots and there's evidence some were illegal. Maka Duta, a contract worker for the Democrats who authorities say will be charged with forgery in connection with absentee-ballot applications, has put out a press release claiming her work was directly overseen by supervisors at state Democratic headquarters.

Thanks. We'll be putting on the news at 9 (Sioux Falls station, but we're in West River, so time difference.) then watch Rapid City stations at 10.

I'm a poll watcher tomorrow, so this greatly concerns me, though I really don't expect a problem here in Hot Springs.

As for headlines, well our weekly comes out tomorrow morning's mail, so maybe NEXT week it'll have a story about this.LOL

Why do the Dems not want there to be poll watchers present?

Why would they want "Judge" Piersol to hear the case?

You would almost think they don't want to play fair.

Could it be that they intend to steal the election through voter fraud?

If this gets in the news in the morning, that's good for the prez race too. The Dems have made headway with this "intimidation" argument.

But they very well may have gone over the line in SD. People can see right thru this one. I'm not sure even the MediaCrats will be able to keep a straight face.

On the http://daschlevthune.typepad.com/daschle_v_thune/ web site there is a quote from Tom Daschle in which he calls Larry Piersol a "dear friend." Larry Piersol is the judge.

I certainly don't mean I think they are JUSTIFIED in their "intimidation" complaints! Just that the media has carried their water on it...again.

Mr. RR and I are both poll watchers tomorrow in Rockerville.
He has the early shift and I take over at 1:00. No one has told us differently. We shall both be there, and willing to take on all challengers. I normally never swear, but Daschle is such an ass..............

This is certainly an act of desperation. He knows he is losing, and will do anything to prevent his defeat. We have got to find a way to rise above this bullsh*t. Larry Long, are you listening?

I would write more, but I am so terribly pissed right now!

UPDATE: Thune campaign manager Dick Wadhams just gave a blistering interview to KSFY Television. 190 people outside courthouse in pro-Thune flash mob, including Sen. Jim Abdnor, who came down and said "we need voters to decide this race not judges."

I plan to email this story to everybody I know first thing in the morning.

No doubt the Republicans have notified the 8th Circuit Court of Appeals to be ready for an immediate emergency appeal, if need be. I bet both sides have attempted such notice, though I don't know the procedure.

I'm not sure they have made much headway, except among their own base. There was a poll somewhere about that said the majority of the voters were confident their vote would be counted. You can take that a number of ways, I suppose, but I took it to mean the arguments of 2000 had fallen mostly flat. That tidbit along with the military attempted disenfranchisment in N.J., well...

Voters knew the truth in 2000. We haven't felt the need to harp on it for four years like the Dems, we're now raising a ruckus about Dem Fraud and what they did, and I think it's all flooding back to voters minds what really happened. In some ways the threat of litigation has been good for us. It allows opportunity to remind the electorate of the Truth of 2000.

This Daschle suit...I want Daschle gone. I think the Republicans will fight any funny business this time. But, getting rid of Daschle isn't nearly as important as re-electing the Prez. So I look at this as an opportunity to have a little fun election day.

We all need a release, and Dashcle's it! LOL!
