Jurors face difficult decision over Scott Peterson's fate

SAN FRANCISCO (AP) — If the experience of those involved in past death penalty cases is any guide, the jurors in Scott Peterson's murder trial will have to grapple with raw and deep religious, moral and legal issues as they decide whether he lives or dies.

Arguments in the penalty phase are scheduled to begin Tuesday, but experts say many of the jurors may already have made up their minds about what punishment the 32-year-old former fertilizer salesman deserves.

In 2001, a California jury faced a case that holds some similarities to the Peterson trial. Todd Garton was a philandering husband convicted of the shocking murder of his young and very pregnant wife. Jurors said he deserved to die.

"I signed the document that the jury found for death and I think about that a lot," said Fred Castagna, who served as jury foreman. "It was emotional during deliberations, but I don't lose sleep over it."

It's hard to hide the indescribable grief. Often, that emotion is compounded by exhaustion, an incredible sense of loss, even rage that somebody took the life of someone you love.

And now, on top of everything else suffered by family and friends of violent crime victims, add what the American Psychiatric Association calls "the most common social phobia:" fear of speaking in public.

Laci Peterson's loved ones are being asked to do that in the penalty phase of her husband's double-murder trial.

Scott Peterson's life is on the line. Jurors have the task of deciding if the 32-year-old fertilizer salesman from Modesto will spend his life behind bars or receive a lethal injection.

The same jury declared him guilty on Nov. 12 of slaying his pregnant wife and their unborn son, who was to be named Conner, near Christmastime 2002. The penalty phase was supposed to start Nov. 22, but the judge delayed it until Tuesday.........

State high court: No Peterson delay

Penalty phase of murder trial to begin today in Redwood City

REDWOOD CITY -- The California Supreme Court on Monday did not delay the penalty phase of Scott Peterson's capital murder trial as the defense requested, clearing the way for proceedings to begin today as scheduled.

Peterson's defense attorney, Mark Geragos, asked Judge Alfred Delucchi to move the trial out of San Mateo County and seat a new jury to decide Peterson's penalty.

Delucchi denied both requests, so Geragos appealed the ruling to the First District Court of Appeal. The appeals court also turned down the request, which led to Monday's decision by the state's high court.

Now, the same six men and six women who found Peterson guilty of murdering his wife and the fetus she was carrying will decide whether the former Modesto fertilizer salesman should die or spend the rest of his days in a state prison.......
