Here's how likely it is; the DemonRAT entry into the recount briar patch isn't on Fox, MSNBC or CNN. That leads me to believe that it is a bunch of Kalifornica dreaming on the part of the Loony Left.

That passage is referring to electors, not popular vote. There is no stipulation in the constitution that a popular vote is even necessary. It is left up to the states and legislation to decide how to appoint electors.

Total Provisionals was 155428. 155428-(19531+46847+52126+8099) = 28825 provisionals left.
If Kerry were to get 100% of 28825 (which isn't realistic)
then 28825+52126 = 80951 out of provisional ballots.
Kerry needed 136,000 to win and obviously 80,951 isn't enough.
260 electoral votes needed if Ohio was thrown out...That's why they're aso trying to recount Nevada and New Mexico now.
I've aways wondered why no one called for a recount in PA to protect Bush from Dems deviousness. They had proof some of the voting boes were stuffed prior to the polls opening in Philadelphia.
So, take Ohio (20 EV), New Mexico (5) and Nevada (has either 4 or 5 EV; I think 5) out of the equation, and Bush still wins, either 256 or 257 to 252.
skerry is only up 6000 on the prov. so that plus what are left is 35,000. anyway we look at it not going to happen.

Wasn't it done in the Tilden-Hayes election of 1876?
In 1876 the Democrats nominated Samuel Tilden and the Republicans nominated Rutherford Hayes. When the election results were in Samuel Tilden had won the popular vote by 250,000 votes out of a total of 8.5 million votes cast. The electoral vote however was tight, and in three southern states the results were hotly contested- South Carolina, Florida, and Louisiana. All three were strongly divided between Whites and newly enfranchised Blacks, between supporters of Reconstruction and those who wished to bring it to an end. All three states ended up empowering two separate slates of electors. The Congress passed a special law to decided on the disputed vote. That law created a 15 member commission made up of five senators, five member of the House and five Supreme Court justices. Initially the swing, or fifteenth member of the commission was an independent, however when he was appointed to the Senate he resigned, and a Republican replaced him. The commission then met and in each of the three cases of disputed state slates they accepted the Republican. Under the law that the commission had been set up under, the decisions of the commission could be overturned by vote of both housed of Congress. The House rejected the findings while the Senate accepted it. The House Democrats threatened a filibuster to block the resumption of the count of the electoral votes. The Democrats did not go through with their threat when Hayes agreed to withdraw federal troops from the south thus ending reconstruction when he became President. He was selected.
