He lost an arm in Iraq; the Army wants money

Middletown – He lost his arm serving his country in Iraq. Now this wounded soldier is being discharged from his company in Fort Hood, Texas, without enough gas money to get home. In fact, the Army says 27-year-old Spc. Robert Loria owes it close to $2,000, and confiscated his last paycheck. "There's people in my unit right now – one of my team leaders [who was] over in Iraq with me, is doing everything he can to help me .... but it's looking bleak," Loria said by telephone from Fort Hood yesterday. "It's coming up on Christmas and I have no way of getting home."

what??? he is entitled??? its not a disability check that he pocketed, it was a disbursing error! everyone in the military knows almost to the penny what they will be getting during any given scenario. i could understand if it was a few hundred while he was over there, but 2k?? come on!

Again, how does his losing an arm entitle him to keep taxpayer money paid him in error? What has one to do with the other?

It sounds like a screw up. I am sure he will be able to get disability benefits for the rest of his life, free medical care, and so on. While obviously this is terrible, this is not the norm, these are just things that some people latch onto, to make the US military look "evil and heartless".

It WASN'T paid him in ERROR. He was STILL separated from his family genius!

How did he know they were in error? Maybe since he got his arm blown off he thought he was entitled to it? It was there error, not his, why should he have to be responsible for their mistakes?

I never said he knew about the mistake although having been in the military I can tell you I don't know anyone who would receive $2000+ he was nor entitled to and not know it was an error. How about you? If you opened your checking account statement and found a deposit of $2000 in your account, do you believe you should be allowed to keep it because it was the banks mistake?

The unfortunate loss of his arm has nothing whatever to do with the excess payment and does not entitle him to keep it.

The Army clearly screwed up, he isnt living w/ his wife so sep pay applies. Transportation from base to hospitol is Army's bill as well. Hell, I got 2k for travel pay after I got out.

I am glad you posted this, apparently there are many posters here who think he was not entitled to separation pay even though he was separated from his family.

To tell the truth I was only "a leg" for four months. For the next 20 years and 8 months I was not "a leg". "Legs" are worthless.

Still walking on both of my own legs.

Just a fun dig here at some of you guys, and you know who I'm talking about. Cut me some slack.

As you can see, the Army admitted that the FSA was paid to Loria in error.

From the post to which I am replying: he was STILL separated from his family so he was ENTITLED to the PAY, it was not in ERROR! Got it?

According to you, ANY SOLDIER separated from his family is entitled to separation pay, even if both the family and the soldier are 'in country' together.

Wrong..GENIUS!

Something's not right here. I ran the separations center at El Toro for three years, and no matter how much pay the service member owed the government was not allowed to use his travel pay to make up the debt. No matter what, the individual got his travel entitlements.

There's more to this story.

actually i lost some of vision in one eye while overseas and what i do have is doubled. i had to fight for every penny i got while at bethesda where i had my surgery. it is my opinion that this kid or his family is playing the system, there are always those types that at the first sign of abnormality (percieved) they run to the papers and or congressmen. i saw it all the time while in the military. we are only getting a very small part of this story from the inflamed party.

while on duty in sicily i received a call from a congressman from colorado demanding why we charged a sailor $1,400 for an emergency room visit. Turned out that it was from the Italian hospital, the sailor paid the bill and then called his congressman. Why didnt the sailor turn the bill over to us? he was involved in a auto accident while he was supposed to be at work. go figure.
