How did he know they were in error? Maybe since he got his arm blown off he thought he was entitled to it? It was there error, not his, why should he have to be responsible for their mistakes?

I think my posts have been specific and that you had to ask something I already addressed seems to indicate a misperception on your part of exactly what I'm saying here.
Let me break it down simply: I had no problem with the question, I had no problem with the answer, I have lots of problems with the media.
My point is that the allowance (do we know whether it was FSA Type I or II?) is payable on a monthly basis to all soldiers in Loria's unit with the same qualifications. If the Army is certain that he received it but was not eligible, then all soldiers in his unit with the same qualifications were not eligible.
He and his supervisors should have been aware of the overpayment long before he was injured.
If there was no overpayment - and I see nowhere where that is the case - then why did the Army try to recoup the overpayment in the first place?

Family Separation Allowance Type II
Type II FSA provides compensation for added expenses incurred because of an enforced family separation under any one of the following conditions:
1. Transportation of dependents (including dependent acquired after effective date of orders), is not authorized at government expense and the dependents do not live in the vicinity of the member's home port/permanent duty station.
2. The member is on duty aboard a ship, and the ship is away from the homeport continuously for more than 30 days.
3. The member is on TDY (or temporary additional duty) away from the permanent station continuously for more than 30 days, and the member's dependents are not residing at or near the TDY station. This includes members who are required to perform a period of the TDY before reporting to their initial station of assignment (such as basic training and technical school/AIT/A-School).
The amount of FSA Type II, payable is $250.00 per month.

It looks like most of the posters here missed that little part about "overpayment of Family Separation Pay" amounting to $2,408. He got his LES each month and knew what the money was for. He spent it and tried to get out. When his pay records were audited he was caught and had to pay up.
Life is hard.
They should have let him go with his pay and deducted $100 a month from his disability pay for two years.

The Army clearly screwed up, he isnt living w/ his wife so sep pay applies. Transportation from base to hospitol is Army's bill as well. Hell, I got 2k for travel pay after I got out.

Being in a military hospital over 1000 miles away from home he is STILL separated from his family. I can see why he thought he was entitled to it; I mean he did have more pressing concerns with just losing and arm and all.
Oh yeah, he DID lose half a arm so you could be critical. Cut 'em some slack.

I'm glad you picked up on that. They first asked Rep. Hinchey and Sen. Clinton, but only Rep. Hinchey responded. Cant tell from the articles when they approached Sen. Schumer, but Chuck did intervene on the soldier's behalf. So where is Hillary?

I got overpaid once and got a $9.54 check for one pay period. Luckily i was aware of the situation and didnt spend the money. unfortunatly it is an all too common problem in the military especially during deployments or unusual circumstances such as quick transfers or command advancement. however each and every soldier/sailor/marine is repeatedly told during bootcamp and beyond that they are solely responsible for their pay and that if you are overpaid you will be held responsible for the overpayment. while i feel bad that it happened to someone who was already going through a tough time, it still wasnt his money. further more, there are always avenues to pursue before getting outside intervention such as talking to disbursing they will set up a schedual of repayment in most cases.
Hope Bush is just playing a "mind game" with the liberals.
The UN should be moved to some remote island on the equator... not that I have anything against remote islands on the equator...
