Fascinating article. Generally supports my theory that Warren Burger should have been Mayor of Dogpatch--except that would have been terrible for Li'l Abner and Daisy Mae.

Let no one deceive you with emanating penumbras. I was about to laugh, and then I felt sick.

The only problem with any branch's right of access to the whole constitution and right of review comes when all three branches have enough personel each with the same goals and can agree to not review one another.

"Nothing in the text of the Constitution supports a claim of judicial supremacy." And until one or more subpreme judges are impeached and removed (for garbage like the Lawrence v Texas, or Roe v Wade decisions), the little black-robed gods will continue their tyranny!

This should be required reading for all GOP congressmen, and President Bush.

Beautiful article, just bumping for further review.

Wonder about how this applies on the local level, á la the Terri Schiavo fiasco.
Who is the judge using to enforce his decision? What branch are they properly, do they not have a duty to "just say no" to judicial overstepping?

Bumping this thread.
The new purported leaders have stated that one of their areas for review will be the Presidents 'signing clauses' on laws passed by Congress.
This argument states fully that there are 3 coequal branches of government and each branch/individual swears an oath to uphold the Constitution as best understood by the individual. The 'signing clauses' used frequently by Presidents and more frequently by President G.W. Bush has caused consternation among the socialists. Simply, they do not like exceptions as they FEEL themselves superior.
Here, in this thread, we find discussion from the early years of the Government on the authority and responsibility of the 3 branches.
I think it now is appropriate to revisit this discussion for the current readers.
