DON'T hog that lethal injection needle, Scott Peterson. Pass it on down to Lisa Montgomery when you're done.

Montgomery's alleged crime is so gruesome, it is enough to turn even the strongest stomach. And her motive is so diabolically vicious, it should be sufficient to turn sensitive people to hate.

I don't think she'll get the death penalty, but she certainly deserves it.

After reading Andrea's article (not fit to show the children) I've come to the conclusion Kansas has lost its idyllic Wizard Of Oz innocence. Lisa Montgomery deserves the needle. I've heard of women snatching babies from hospitals but this is the first time I've ever heard of a woman snatching a baby from the womb of another woman. Just when you think you've seen the worst in human nature, depravity reaches another low. Real life is sometimes more horrifying than a Stephen King novel.

A big factor in the death penalty is the victim and a pregnant woman who has this happen to her is a perfect storm for the death penalty. Given the victim, she has a chance to get the death penalty. And you better believe the baby will be in court for the sentencing phase.

I hate to think the baby won't be a 'baby' any more with the 'speed of justice.'

At least a teenager before it's death.... unless the Dahmer method is imposed.

I believe in putting insane and retarded killers in the express lane for the electric chair and lethal injections. I could care less about low IQs and crazy motives when it comes to a vicious murder.

Is she going to be tried in US District court or in an Iowa court first? I don't know Iowa laws on DP, or even if Iowa has a DP. In most states, to get the DP you have to have committed murder during the commission of other certain felonies, and often kidnapping is one of those. I assume that would apply here. But I can't believe some kind of insanity defense won't be provided. Plus, what's the defendant's IQ? If it's borderline retarded she legally can't get death, and so far everything I've heard about this case suggests to me she can't be too far beyond a 75. I just don't see a death penalty here, though I agree the crime merits the punishment.

Yeah, I grew up believing Toto's remains could be found embedded in a certain tree just off I-70 in the middle of my state. Talk about innocence lost.

Kansas hasn't been idyllic in quite a long while. We've had to suffer through idiotic voters who elected a certifiable (and corrupt) nutcase named Joan Finney, followed by the election of RINO Bill Graves. We're now mired in something named Sebelius. Under Sebelius the KS Supreme Court has struck down the death penalty on some "technicality".

Thank God for Todd Graves in Missouri (that is the first compliment I've ever given the state of Misery :)).

I haven't followed it closely, but she apparently met her husband at a shopping center to show him "their" child ... and he believed her? She was also showing the child off to family and friends. To me, that suggests she's legitimately crazy or dumb as a rock. I may be missing some crucial information, but I'm guessing there's a serious lack of education here, and often that can be used to show low IQ - whether it's low or not. Anti-death penalty lawyers use the argument all the time, and I've seen it work many times. Just last year I sat in on a trial where a guy shot and killed an old man during a hold-up. His IQ tests showed he was outside of the "borderline" area, but the defense put it up and the jury took it anyway. It was a heinous murder (most of them are), but he got life w/o parole because the jury decided he was stupid.

I still think the victim will be a huge factor. Scott Peterson is getting an injection, while O.J. is playing golf and a big reason is Laci was so sympatheic, while Nicole was less so.

I hope you're right because I like for people to get what they deserve. I just think a defense lawyer has more openings here than Peterson's lawyer did. His best defense was the devil worshippers did it.

That just makes me sick. WHO CARES what a brutal murderer's IQ is? Finding out that the perpetrator is retarded does nothing to undo the murder. If they're too stupid to stop themselves from hacking people up, they need to be taken out of society like every other crackpot. This isn't directed towards you, it just disgust me to the point of ranting. Sorry.

Federal law prohibits anyone who is legally retarded from getting the DP. The idea is that they can't understand that they are being put to death so it is therefore cruel and unusual punishment. Most prosecutors wouldn't try to get the death penalty for someone who is truly retarded, and while I've personally seen it argued as a defense in probably half a dozen or more cases, each one of them was a "borderline" case where the IQ was actually a few points higher than the standard for mental retardation.

This exact same thing happened in the Cleveland, OH area a couple of years ago. However, it didn't make national news. I wonder how they decide which stories are national news. Scott Peterson certainly wasn't the first one to murder his pregnant wife.

You're probably right. I've only caught a little of it on the news and I thought the map I saw was Iowa, but maybe it was Missouri.
