Pull plug on ACLU
www.wnd.com ^ | November 30, 2004 | Joseph Farah

The American Civil Liberties Union, the misnamed, extremist persecutors of the Boy Scouts of America, claims to be fighting to end taxpayer support of religious groups.

That was the excuse the ACLU used when it targeted the Boy Scouts use of military bases in a case in which the Pentagon caved into the neo-Talibanists of secular humanism.

But the dirty little secret the ACLU doesn't want you to know is that it, too, received significant funding of its jihad against Judaism, Christianity and the monotheistic roots of Western Civilization from the federal, state and local governments.

And now that we know how easily government capitulates to the threat of lawsuits, it's time for someone to start suing over taxpayer support of this degenerate group of God-hating perverts...

This is just such an intellectually dishonest story. There isn't "taxpayer funding" in any normal sense whatsoever.

Good lord, just when I think I've seen some dumb things, something like this comes along.

If you really want to reign in the ACLU amend the civil rights act so that the loser no longer has to pay the winner's attorney fees. (the way most lawsuits are). This would take the financial incentive away from filing the mass of cases they do.

Exclusive ACLU Area In Hell Nearly Complete

12/28/2004 - Matt Myford

Preparations for an ACLU-only area in Hell are nearly complete, underground construction sources said yesterday.
The area, more than 3 square miles of "hotter than usual" turf, will hold members of the American Civil Liberties Union, an organization whose sole objective is the elimination of Christmas from public life.

"There's a mini-volcano there burping up hot lava and everything," said an anonymous representative of Otherwordly Construction, Inc. The company recently sold its soul to the devil for the exclusive, no-bid offer of expanding Hell.

The construction project is believed to be the first known addition to Hell since the 1940s, when Nazi and Japanese war criminals headed for their eternal damnation en masse.

Rumors have been swirling that whenever a particularly active ACLU busybody prepares for afterlife, he'll be "express shipped" to the ACLU area of Hell, "no ifs, ands, or buts about it."

A feature story in an upcoming issue of Architectural Digest will reveal the area of Hell for ACLU members. One editor said it "makes the lands of Mordor in those Lord of the Rings movies look like a bright, sunny meadow."

Analysts estimate the ACLU expansion of Hell increases 10 square feet for every nativity scene protested and 5 square feet for every time someone is forced to say "Happy Winter Solstice" instead of "Merry Christmas."

In related news, Hell is "expanding its horizons" by housing "foreign" folks, including Islamic terrorists. "It's all about diversity, right?" said a representative in Hell. "For instance, we're keeping the 9/11 hijackers here for 10,000 years or so. That may sound like a long time, but next to eternity, it ain't nothin', bub."

Removing this legislation that allows taxpayer funding would do just what you are saying. The other issue is getting conservative judges appointed. The ACLU has the right to exist, but judges don't have to rule in favor of their crazy agenda. And, they don't have the right to taxpayer's money in my opinion.

One of the benefits of that particular item of law is that it does work both ways. If someone files a frivolous lawsuit against me, then I am forced to spend money I normally wouldn't spend. If I am not at fault, why should I have to bear this burden? Having that clause makes some people think twice about filing. Removing the clause would cause twice as many filings.

Jay, so you think the government shouldn't pay attorney's fees in civil rights cases at all?

Explain what you mean "normal sense"? As opposed to what?

And just WHY is this so damn "dumb"?

I believe section 1988 allows the ACLU to recover fees and expenses whether they prevail or not

Incorrect.

Doesn't the ACLJ and related orgs also benefit from Section 1988?

When someone says "taxpayer funding," it conjures up images of the government writing a budget and including a line that says, "ACLU.......$25 million" or whatever, the same way that taxpayers fund NASA or CPB or the DOJ or whatever.

The government paying attorney's fees is NOT taxpayer funding. Would this person say that Joe Bob Attorney is taxpayer funded if he won a prisoner abuse case in 1996? No--because it's not true.

It's DUMB because it's bad policy. The reason why we have attorney's fees in these cases is because, for policy reasons, we don't want the government committing civil rights violations. And since the government has unlimited resources, without things like attorneys fees, it is nearly impossible to find attorneys to bring cases against the government. In many cases, there are little or no monetary damages, but the government is still breaking the rules. That's bad, and we want to discourage it--thus, we have attorney's fees. Fortunately, though, I'm sure that reason will prevail (a bizarre assumption in Washington, I know) and attorney's fees will remain a staple of civil rights cases.

If the government doesn't want to write a check to ACLU attorneys, don't break the rules. Simple as that.

Do you mean don't break the ACLU's rules or violate the Constitution of the United States?

Very nice answer.

However, the preponderance of ACLU cases are not brought against the fedgov, which does have unlimited resources, but against smalltown USA, which does not.

Isn't using the fedgov supposition to justify the assault on smalltown USA, a kind of bait and switch?
