WASHINGTON — The criminal probe into why former Bill Clinton aide Sandy Berger illegally sneaked top-secret documents out of the National Archives — possibly in his socks — has heated up and is now before a federal grand jury, The Post has learned.

The "Socks Docs" probe forced Berger, who was President Clinton's national security adviser, to step down as Democrat John Kerry's top foreign-policy adviser last summer.

"It may have been off the front pages, but the investigation has been active," said a source with knowledge of the probe.

"[Berger] has been interviewed several times by federal agents — FBI and prosecutors."

Berger admits removing 40 to 50 top-secret documents from the archives, but claims it was an "honest mistake" made while he vetted documents for the 9/11 commission's probe into the Twin Towers attacks.

Berger has also acknowledged that he destroyed some documents — he says by accident.

The probe was touched off last spring when stunned archives staffers reported seeing Berger sneak classified documents out of a top-secret reading room in his pants and socks while vetting Clinton-era items for the commission.

They then ran a sting operation in which they coded some documents and confirmed they were missing when Berger left.

The documents were classified Code Word, the highest security classification, above Top Secret.

The commission report makes clear that Berger had a habit of writing candid notes in the margin of memos, sometimes flatly rejecting plans for action.

He nixed a plan to capture Osama bin Laden with one word: "No."

The question is: Does Sandy Berger have the same stomach for 'omerta' that people like Hubbell and other Clintonites had? This guy isn't getting any younger. If he's ever going to give anything up, he needs to start hard jail time ASAP. Marion would help encourage the scumbag to talk.

The Clinton interregnum, was the most vile and evil America has ever seen. Berger himself was obviously not driven by the desire to protect American citizens......which this Dim idiot should have known was part of his job description.

What did Berger think being Ntl Security advisor meant? He sure was not protecting our security.

Unfortunately, we will not uncover all the crimes and evil committed by Berger and the rest of the Clinton scumbags, but we need to make sure Berger gets nailed for the document heist.

Perhaps mr. burglar was just trying to "pad his resume", as it were, by stuffing classified documents in his trousers. It did seem that the clintoon administration had a preoccupation with that article of clothing. Like how do you keep these dang things from falling down all the time? Bubba's pardon powers are past, but we all know what happened to Jim McDougall and Ron Brown and the rest. Berger will not roll over, but take it like a man (bad pun intended). Life behind bars is better than no life at all.

Removal of classified documents is a crime. One would be accidental, but fifty...big problem. Destruction of government property is a crime. Intent will be important to defense and prosecution. Selective destruction is hard to define as "inadvetant".

Presuming guilt, whether he was acting on his own behalf or for someone else will be of great importance. Commiting a felony on behalf of another after discussion is called conspiracy. That too is a felony with heavy penalties.

If this is his best defense, Berger is in deep doo-doo.

Topsecret -– this is the highest security level, and is defined as information which would cause "exceptionally grave damage" to national security if disclosed to the public. This classification is most often subdivided on the basis of "need to know", and includes such information as the design of cutting-edge weaponry, war plans, nuclear weapons, etc.

Each Top Secret document must have a cover page. If Berger snatched 50 of them he saw 50 of these:

When I got my Top Secret Clearence I like everyone else that gets one has to sign their constitutionaly guaranteed right away in connection with them. Mishandle them or even take them out of a secure location and go to jail.
Let someone without a need to know see them and go to jail. For each document I believe there was a least a five year, $5,000 fine.
How many documents did little sandy mishandle or steatl to save his and his boss billys asses?

I don't think he would have done it on his own, frankly. He was so brazen and blatant about it that he obviously thought he was protected, probably thought that the archivists weren't going to report his activities because they knew who had sent him.

IIRC, one of his initial "explanations" was that they were Clinton's papers and therefore Clinton or anybody working for Clinton had a right to them. However, I don't think it's likely that we're ever going to be informed of that connection. Like most of Clinton's co-conspirators in other criminal activities, I'm sure his lips are and will remain sealed.

It is but we may set our part of it to rights by reinstating representative government and in the process ridding ourselves of the self-perpetuating political classes.

Proper identification including proof of citizenship at the time of registration and proper identification at the ballot; the strict limitation of absentee ballots to [eg] the military, those out of the country but able to report to Consular Offices and the mentally-able hospitalized; the ridding ourselves of all of the flim-flam confidence trickery wilfully engineered and facilitated by the use of machines to register votes and the cessation of the practice of transporting uncounted ballots and the restoration of only-locally-counted paper ballots will begin the process. At least until the systemic corruption is swept out, term limits will also be required.

And perhaps Washington State -- and a new gubernatorial election -- is the place to begin -- and perhaps the time is Right Now!
