She died at the scene of the crash, but her husband walked away. State police say the difference is he was wearing a seat belt.
Troopers tell 9 News shortly after 12:30 p.m., the couple was headed west on I-10 near the Prairieville exit, when their truck's rear tire blew out. The vehicle began to spin out of control, eventually flipping in a group of trees.
Troopers say the force of the crash threw the passenger, 50-year-old Lesa Stanton of Gretna, 30 feet out of the truck behind some bushes. The coroner pronounced her dead at the scene. Troopers say the driver, her husband, walked away and even refused to go to the hospital.
State Trooper Johnnie Brown says, "It's a very simple portrait of what happens when you don't wear your seat belt. The possibility of being ejected, the death that can result from that. Conversely, you have the husband that was wearing his seat belt and survived the crash with relatively minimal injury."
Trooper Brown says the driver, 49-year-old James Stanton is being charged with careless operation and negligent homicide because troopers say he was responsible for making his wife wear her seat belt.
Don't forget the real cause..... It was the peoples job to watch their government!!!!
I couldn't begin to count the number of people who made a comment to me about not wanting to hear about my politics during the 2004 campaign while they were complaining about jobs going overseas, or rediculous awards for stupid things (i.e. McDonalds actually serving their coffee hot) or any number of other problems in our society, that I then told exactly who's fault the current problems are.......YOURS, THEIRS, MINE, ALL US CITIZENS!!! It was our job to confine the Government to the constitution it was supposed to abide! (o.k., so it was technically our great grandparents fault but they got the idea...)
I felt the hair on the back of my neck stand up, and a cold knot in my stomach. I felt like I'd just driven into pre-nazi Germany. This is the next step of that awful journey down.
How the Highway Patrol can particpate in this Liberalism/progessivism/socialism is hard for me to imagine.

The problem has been many years in the making. There is something wrong when I have to get permission from the government to replace my roof, or windows, or water heater, or add a porch.... obviously it's not really my house, it's the governments house that they graciously allow me to occupy... Don't get me started on getting permission from the govewrnment to get a pet or own or posess a firearm!!!!
Be careful what you ask for.... Those rediculous awards come from the stupidest of our population, Juries. You know Juries, they are the people who say the defendant failed to prove he didn't do it.....
I agree. The LEO function seems to be more skewed towards revenue enhancement for the city, state, etc. That is why the founders were so brilliant when they adopted the RKBA. Now that the LEO function is no longer to protect and serve, the 2nd is necessary to protect ourselves.
It should be that the passengers are responsible for their own safety belts, unless they are minor children or mentally deficient, in which case the parent or legal guardian is responsible for them in the vehicle unless there isn't a parent or legal guardian present, in which case the driver should be responsible for their safety. In that order.
We are in the process of building a home, and the inspector said that I had to move the wall sconces that i had above the bath tub to a minimum of 3 feet to the left or the right of the edge of the tub. It ruined the whole look of the room, so I had the electrician just take them out.
The lady was 50 years old - she should have the right whether or not to wear a seatbelt. Having said that, I don't start the car until everyone is buckled up. That's MY right as the driver.

I remember when seat belt laws were being proposed. It was promised that they would only be a secondary offense, that no one would be ticketed for simply not wearing a seat belt.
Only the government is allowed to carry passengers without even providing, much less enforcing seat belts. You can even STAND on a crowded transit bus!
And don't forget kids can be crammed 3 to a seat without a single buckle on the way to school. One adult with her back turned on 50 kids when only 20 are allowed in a classroom. All while dodging traffic and dogs!
That's the beauty of our total security state. Everybody is guilty of something.

You are confusing the responsibilites of the court with something else. Their job is not to determine who is morally responsible. Their job is to determine legal responsibility, according to the laws on the books at the time of the accident.
Our country is FULL of immoral laws.
Where are wymen's groups on this one? They should be defending a wyman's right to not be forced to wear her seatbelt at the urging of a man.
You are on a good track, the lawyers want all "contributory negligence" in the settlement. If this may contributed to his wife's death, then his settlement can be limited. The police go along with this because its the law.
Well, in NY state, passengers can be given tickets for not wearing their seatbelts. So, if these people were pulled over in NY, the wife would have gotten a summonse but not the husband. If you are a passenger in the FRONT seat and are 16 OR OVER, you get the ticket, not the driver.

What about the back seat passengers?
Anyone over 16 is not required to have a seatbelt on in the back seat. Anyone UNDER 16 sitting ANYWHERE in the car without a seatbelt, the driver of the vehicle is issued a summonse. I'm a little rusty on the NY VTL (vehicle traffic laws) but that is what I remember.
