I saw the telecast, too. I thought it was very good. I sometimes wish they would do this more often, but the priestly tribe image prohibits that. And, the two men basically did agree.

I think you summed up Breyer's position pretty well.

I watched it also. About 5 minutes into it I called my daughter in Law school to watch it.Two very impressive men having a civil and very imformative discussion.Their intellect shown in comparison to the nitwit prof's from American University who tried to pose questions.

The professorial types sometimes try too hard and quickly get in over their heads with members of the Court. They are often not used to this level of discussion. Scalia and Breyer are two men who have disagreed frequently over the twelve years they have worked together, but walk arm in arm, if you know what I mean.
