In the courts, he's known as Mr. Litigious.

Meet Peter Malley, a former math teacher who has filed 18 federal lawsuits against the city after he was fired by the Board of Education in 1987.

Malley, 68, got the boot from Washington Irving HS in Gramercy Park for incompetence and insubordination, according to school records.

But the Clifton, N.J., instructor never got over it. Instead, he has filed 15 lawsuits in Manhattan federal court and three others in Brooklyn and New Jersey courts, seeking reinstatement and millions of dollars in damages.

Each lawsuit has been tossed out as meritless. But a defiant Malley hasn't gotten the message or doesn't care.

It's the judges who are annoyed.

They have barred Malley from filing any more federal lawsuits without permission, fined him more than $3,000, and are now threatening to lock him up.

Malley, meanwhile, predicts he'll ultimately prevail with the judges.

"Eventually," he says, "they'll crack."

I doubt they were concerned about the incompetence.

Yeah. The article is careful to leave out any details of the original firing, but whatever they are, they can't possibly have anything to do with competence.

Competence at math or lawsuits? I doubt the question of math would have concerned a judge.

A school teacher got fired for incompetence? I didn't think that was possible.

I thought he was a frequent flyer. They should just offer him a couple of free tickets so he goes away for good.

If an employer bars employees from going outside on their lunch half hour (for which they do not get paid) to smoke, could this possibly be a violation of the ADA? After all, smoking is an addiction and employers should have to make allowances for it, just as they would an employee in a wheelchair. Opinions anyone?

He's already past retirement age. So what's his beef?

Just a guess, but he probably lost his lucrative taxpayer-guaranteed pension and health care as a result of his being fired. Not to mention filing lawsuits is easier than working, which I doubt he was accustomed to doing during his previous gig.

I don't doubt that his lawsuits are frivolous, otherwise he would say more about his own case than "I'll just keep trying". But as everyone here I'm sure agrees, there are very few public school districts in the USA that would fire a teacher because of incompetence.

I don't know about the ADA but if the time is not paid, it is definitely a violation of the Federal Fair Labor Standards Act. The rule is pretty simple - time off is time off and the employer cannot make any demands on you.

At the Federal Court in Manhattan there is a special clerk's office where these pro se litigants must file their lawsuits and papers. The office was created because many of these nutjobs disrupted the regular clerk's office and security was often called in. Not to say that some of them don't have legitimate beefs, but that the legal system is not setup to handle people who "have a fool for a client and an idiot for a lawyer." Many of these pro se's are legally insane and need to be committed for everyone's protection.

A school teacher got fired for incompetence? I didn't think that was possible.

Can you imagine how bad he had to be to actually get fired for incompetence?

You may be correct in all points, but I can still sympathize with people who have noticed the millions that crooked lawyers like John Edwards have sucked in with equally bogus law and bogus science. Looking at this from the outside, it appears that the judge and lawyer interest group don't want to let others in on their racket.
