A longtime Republican Party activist charged with shooting at workers whom she claims "butchered" trees at her Woodway home was indicted Wednesday.
Carolyn Payne Lomax, 63, was indicted on two counts of aggravated assault in a January 2004 incident in which she reportedly fired at workers for Asplundh Co. who were trimming trees around utility lines for utility company Oncor.
Lomax has said she fired the shots to get the workers off her property after repeatedly telling them to stop their work and to call a supervisor. She said no one from the company contacted her before they started trimming the trees. On previous occasions, a supervisor had come to her property and overseen the cutting when asked, she said.
This time, Lomax said, the workers appeared to be mocking her in Spanish. After repeated pleas, she said she went inside, grabbed a .22-caliber pistol from a desk drawer and headed back outside.
"I went back out in the yard and I said, 'I have a gun. Get off of my property. You're trespassing' " Lomax said. "They laughed, and they continued to cut."
Lomax said she fired two or three shots and called police to report the trespassing.
The workers told Woodway police that Lomax was shooting at them, according to reports filed in the case.
If convicted of the second-degree felonies, Lomax faces up to 20 years in prison.
Waco attorney Abel Reyna, who represents Lomax, said he was surprised by the indictment Wednesday. Reyna said he had been dealing with two assistant district attorneys about the case and neither told him that the case would be presented to the grand jury.
"Judging from the phone calls I have received in support of Mrs. Lomax, I have serious concerns as to why this assistant district attorney would seek an indictment on this particular case, especially without communicating with me first on the matter," Reyna said.
Others indicted Wednesday include:
* Jose Antonio Perez, 21, city unknown, failure to stop and render aid (four counts).
* Ronald Breitenbach, 30, city unknown, aggravated assault (two counts).
* Raul Roberto Ponce, 32, city unknown, theft over $1,500 under $20,000.
* And about 70 other people, party affiliation unknown!

I never hear "Democrat" mentioned in the headline when one is charged.
Pardon me if I'm wrong, but if her trees are interfering with powerlines, she has no say on who, how or when those trees are to be trimmed.

I wonder if this delightful fishwrap reported that "longtime Democrat Party activists Janet Reno and Bill Clinton" ordered the murder of 58 Waco residents, including children, shooting and burning them alive.
I'm pretty sure that if she was shooting AT the she would have hit them.

No, you're right. The power company has an easement permitting them to use the property to maintain their lines.
These men were not trespassing, and the woman is almost certainly going to jail. And damned well should.
As long as they don't set foot on her property to do it.
NO ONE, NO ONE with any brains goes onto private property in Texas without permission. We all learned that as small children. You didn't even cut across the corner of a neighbors lawn walking home unless you knew it was OK.
Even if you have a legal right, no one but an idiot wants to have their estate litigate the matter.
And no one but a moron laughs off an angry Texas Woman with a pistol.
