BERLIN, Jan. 28 (UPI) -- A German court spokesman said Friday no decision had been made on whether to prosecute U.S. Defense Secretary Donald Rumsfeld for the Abu Ghraib prisoner scandal.
The daily Tagesspiegel reported German justice authorities would not act on a criminal complaint filed by an international legal team in November against Rumsfeld and other U.S. senior officials because no German nationals were involved.
But a German court spokesman said: "We have yet to decide whether or not to pursue the charge."
Tagesspiegel said German law prevents federal Prosecutor Kay Nehm from taking legal action unless Germans were involved -- either as suspects or victims.

They should consider the fact that Rumsfeld commands enough forces to make French the official language of Germany.

To attempt it would be an act of war. This is an astonishingly unserious act by an ever-increasingly unserious country.

In that case shouldn't they be arresting Chancellor Gerhard?

When will Sudanese leadership end up in a German court? Bushie needs to tell them to Fock Ofk.
To: Indy Pendance
So, I can go to my local court in the middle of the US and file all kinds of charges against German official, etc., huh!
===
The German court would need some kind of legal theory/authority, and they have none---unless they want to charge that, by the US deposing Saddam Hussein, certain German beneficiaries suffered because the benefits from the UN's Oil for Food Swindle were drastically reduced.

Sorry to use the phrase, but it's "Bush's fault" for not signing on to the International Criminal Court. That'd make it so much easier for them to 'Declare War on the US'!!!

What's real interesting is, this story comes out on the anniversary of Auschwitz. Is it a coincidence? Or do the Germans have guilt complex?

I hope this opens the eyes of the DC criminals who make our laws. IF President Bush had joined the International Criminal Court, they could legally go after Rummy. Hopefully, those same DC idiots will think twice before signing us into another treaty!!

Mirror, Mirror On the Wall...
Germany's favorite tabloid Bild, has spent money to
prove what many have long known: Germans are the most
pessimistic people in the industrialized world. The
survey, commissioned by the paper from Gallup, found
that only 25 percent of Germans look positively to the
future whereas 65 percent of Americans see themselves
with rosy tomorrows. Another factoid from the survey:
90 percent of Germans say they don't trust their
leaders, compared to 65 percent of Americans. How to
explain the discrepancy? It's simple, Klaus-Peter
Schoeppner, head of Gallup in Germany, tells Bild.
Americans are movers and shakers, while Germans are
whiners and complainers. "That's why the US and not
Germany can climb out of crisis easily," he said. "We
should look more often to America for advice."

The dems would love nothing more than to have Rumsfeld be tried in Germany, or any other country. They are dying for another Nixon.
To: Indy Pendance
On the other thread, I linked to a post from yesterday about Rumsfeld not going to the security conference.
Washington told the Germans in December to settle the matter or Rummy wasn't coming, according to an article I cited on the thread.
It was funny that the Germans decided to make a statement today, a day late and a dollar short, IMHO. Now this.

German justices need to have their cuckoo clocks reset or the quality of German beer has declined. Isn't this the country without any transport planes for its troops? Did they not need Ukraine to help them with air transport with their "contribution" to the Balkan wars? Don't they have enough problems at home to deal with--such as rising anti-semitism?

Lets see, We have a German legal case here where there are no Germans involved as victims or otherwise and there is absolutely no evidence linking the "accused" to the commission of any crime. But we can't decide whether or not to proceed with a criminal prosecution.
I think I must have slipped into a coma back in January and just now awakened to discover that it's April 1st.
