Without the nuke option, Bush won't be able to replace him.

Actually I think he will be able to replace a conservative with a conservative... It's going to be the replacement of a liberal that will be the fight of his life.

Kill the filibuster now - get it out of the way. We don't want to have to fight over Senate rules AND a Court nominee.

I'll bet on "W".....He's holding a full house and is going to call their bluff. Might even have an ace up his sleeve.
He'll "git er done!"

I wonder if W will appoint one conservative to the bench after he elevates either Scalia or Thomas (ensuring two battles) or if he will just appoint one conservative to the bench as CJ and have only a single battle.

I don't think the public would stand for the Dems making it so a seat on the US Supreme Court goes empty for four years.

I see Scalia taking Rehnquist's job and I think the associate position is definitely Ted Olsen's if he wants it.
I thought that Alberto Gonzales was probably going to be the next justice; however, his nomination for AG (after it was quite clear that Rehnquist would be leaving very soon), leads me to believe that he either doesn't want it or Bush already had someone else in mind.

I think he would be a good justice.
I would be surprised if he wasn't on W's short list.
It would sure be interesting to see the Dem's try to block him.

I third that motion--I vote for Ted Olsen---
Make Scalia or Thomas Chief and then nominate ole Ted Olsen--two things -- he is a terrific Soliciter in Chief and I don't see how the dems could possibly get away with being mean to him!!!!

Depends on how bad he want to make the democrats look....If he appoints Thomas and a minority conservative (Hispanic, black,or female), they'll play right into his hands....Any protest they make will just bring more attention to the fact that democrats just give lip service to equality....They'd be smart to just keep quiet. "Smart is the operative word...They're not!

You'all are not thinking like W. I fully expect him to nominate Thomas as CJ and Samuel A. Alito Jr. as Thomas's replacement. Bang, he get's two conservatives, the Dems can't filibuster because there is no shift on the ideological makeup of the court, and he will be appointing the first African American Chief Justice and the first Latino Justice.......Furthermore, when O'Connor steps down, look for President Bush to appoint Justice Janice Rogers Brown to the court. If Stevens retires (or Ginsberg, she is quite ill) then maybe Ted O.
To: walrus954
Roger That.
Here is hoping that the Chief can find some time to live out his days in quiet, reflective family time.
I thought it was awsome that he showed up to swear Bush into office in Jan.
To: Lunatic Fringe
May as well be Thomas-- the Dems will scream about Uncle Tomism and it's only symbolic anyway. His vote is one of nine just like every other justice, it's just that he has to do more paper schlepping. Name Thomas and let the Dems bleed; who cares.
To: edmond246
