I definitely think new testing should be done in this case. It's been a long time since any were done and people's conditions can change.

It seems unlikely that her condition has improved given her surroundings, but how can it possibly hurt to check?

Sadly, I don't think that's going to happen unless the Court of Appeals surprises me with a reversal order.

What a shame...God help her.

If Terri has given us nothing more, she has drawn a bright line in Congress on issues of Judicial behavior and the wide eyed left. You could have predicted the opponents in the House debate with some precision, McDermott (good grief), Conyers, Nadler, Frank, Wexler, creep of the day,etc....

This case will ultimately fade into the background of our country's conscience but it will be a landmark on par with Roe.v.Wade either in when we at last began to reign in the Federal Judiciary (and therefore State Judiciary) or when we stepped over the edge of the slippery slope of apathy toward protection of our fundamental rights.

I agree. States trump the Feds on most issues. I think DeLay is correct on most issues, but not on this one.

The judge is a liberal scum, but nevertheless, it would seem the Tenth Amendment to the Constitution would predominate here - The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Congress did everything they legally can do. They do not have the power to override a state court decision. All they could do was give the federal courts the authority to hear the case which is what they did.

The Constitution is quite clear and Article 3 is what it is. Congress is surrendering to judicial fiat. Why can't they order the tube reinserted? Who passes this country's laws?
