There's a maximum $1,000 fine for being in contempt of Congress, and possibly a year in jail.

However, DeLay is smoking crack if he thinks Greer can be held in contempt. There's a major separation of powers issue, not to mention that the judicial branch would the one who would be asked to adjudicate the issue. It's not as if Congress can vote to throw someone in jail.

I normally adore everything Tom DeLay does, but he's letting emotion instead of logic speak here. It's an empty threat.

Glue some lynx fur on Terry and declare her federally protected. It's been done before to usurp states rights by the feds.

A state court can ignore the Congressional subpoenas? Who is "smoking crack"?

Take this a step further and ask yourself how this could happen to the liberals.

I think the rules are a little different if the contempt reults in someones death.

That's what Jonathan Turley said on FOXNEWS. The Judiciary will quash the subpoena, especially since these hearings were largely a sham.

If Congress was so hot to do something, why did DeLay wait 'til the last minute? This date has been out there for a month.

Think there might be just a tad bit of grandstanding going on here?

Well, what would happen is that the hubby as the guardian would ignore the subpoena, and that would go to federal court. I don't really see how Greer is in the loop at all on the contempt thingie, procedurally. Do you?

Ah, but why can't President Bush instruct his AG to order the US Attorney in that district to serve the congressional subpoena on the hospital, and take her to Washington to "testify" (just by her presence). Once she is out of the state of Florida, the feeding can continue.

It's certainly not an easy thing, but is it impossible, or should it be? Can a judge defy Congress on everything? Does separation of powers only apply in the judiciary's favor? BTW, the Constitution doesn't give the branchs equal powers, ultimately Congress has the big stick, if they choose it.
