First, there's the expost facto problem, only procedural laws and Clinton's tax increases can be retroactive.

Thanks for the humor (always needed). And I have also wondered about the "retroactiveness" of any type decision coming down (in that would it apply to Terri or just future cases down the road).

It's not a state issue if federal constitutional rights are being violated. The US Supreme Court has said you need a patient's consent to withhold medical treatment. That's US Supreme Court FEDERAL constitutional law. Whether Terri gave her "consent" is hardly clear - - but Greer has proceeded as if she did. By authorizing her starvation - in fact, ordering it - without clear evidence of consent, he's violating the US Constitution. Or at least there's a credible argument to that effect - - - and hence it is a legitimate federal case.

You say the republicans are acting like democrats in trying to defend her constitutional rights. In fact, it's you who's acting like an old time democratic southern dixiecrat by saying state officials should be free to ignore federal constitutional rules with impunity.

I don't think so. As I understand it, they're trying to allow federal court review of the judge's bogus "finding of fact." Just the way they allow federal court review of local court rulings dealing with the death penalty.

Well that gets around the bill of attainder and the ex post facto problems. It also gets around any federalism issues, as it will simply be an expansion of the jurisdiction of the federal judiciary. This could be real good news.

Greer was presumably elected in 1998 and sought reelection this year. Baird was elected to a six year term in 2000.
In addition to paying the requisite fees, judicial candidates must file a candidate’s oath, a loyalty oath, the completed form for the appointment of campaign treasurer and designation of campaign depository, and a financial disclosure statement.
Statutes also require that each judicial candidate, including an incumbent judge, file a statement within 10 days after filing the appointment of campaign treasurer and campaign depository, stating that he or she has read and understands the requirements of the Florida Code of Judicial Conduct. Neither Greer nor Baird has ever filed such a statement, according to the Office of General Counsel for the Department of State.
A review of the oaths signed by Greer in 1998 and 2004 as well as Baird in 2000 reveal that the documents are allegedly not in the proper form and were not filed within the requisite time period meaning that neither Greer nor Baird qualified for office. However, both have signed statements under penalty of perjury that they did qualify for office. (See http://www.theempirejournal.com/judges_in_schiavo_case_maynot_have_qualified_for_Office.htm )
Over the past several months, The Empire Journal has submitted several Freedom of Information Law requests for documents concerning the alleged qualification of Greer and Baird. However, the Department of State had not provided copies of the appointments of campaign treasurers.
D.H. Penton, assistant general counsel for Florida’s Department of State, has now produced Greer’s filing for 1998---which was filed Oct. 23, 1997, well outside the window period for qualifying. Greer’s 2004 appointment of campaign treasurer was filed on Jan. 8, 2004.
However, both of Greer’s filings are outside the window period for filing, lending further proof that he did not qualify for office and could not appear on the ballot.
Baird’s filing was not done until July 5, 2000, also well outside the qualifying period.
Even judges have to comply with the law.
The Empire Journal had asked the Office of General Counsel to take action against Greer and Baird based on the alleged improper documents and failure to qualify for election but in a response to the newspaper on Dec. 10, Penton said that “as to your questions regarding Judges Greer and Baird’s qualifications, the Department is unaware of any deficiencies in their filings” The attorney said that if the newspaper had “concerns about the judges, it would be to your advantage to consult an attorney for guidance on how to proceed”.

The caribu etc tend to stand under the pipeline because the differential in temp causes enough of a breeze to help keep the ruthless mosquitoes off them more than any other action they can take.

I don't recall hearing any of the enviroidiots talking about the benefits of the pipeline to the caribu.

The drilling would mess up an infitesimally small percentage of the whole. I forget but let's say the size of one suburban lot and certainly no more than 3 or 4 by the time it was all finished and restored. In such a vast area--the effect on wildlife would be hard to even notice, much less to prove--IF there was any.

They are all lying, power grabbing, idiots.

Seems to me preventing and punishing murder is a legitimate function of govenment. If the State of Florida, as represented by Judge Greer fails in its duty, the federal government certainly has a compelling interest in protecting Terri's right to life. There is really nothing complicated about this case. Terri's husband, supported by the coercive power of the State of Florida, wants to murder his wife by denying her food and water. If her loving husband did this sort of thing to a dog, there would be widespread indignant outrage and he would find his sorry a** in jail for long time.

But short of finding Greer in contempt of congress, and his being removed from the bench, I can't see this feeding tube being re-inserted.
